TfL is trying to force me to pay a PCN that i had nothing to do with.I am the registered keeper but somebody else was utilising the vehicle at the time of the alleged offence.he contacted them and told them so and awaited the paperwork to start making payments but they still want me to pay.they send bailiffs who clamped my vehicle but when they went I took the clamp off and still have it as they never came back yet they still want to send more bailiffs for this fine that is not even mine.They say they don`t take people to court but only deal with Bulk Centre at Northampton,I thought if here is no real court order they can`t touch my vehicle?What`s the latest info on this pls revert back .tks to all who participate on this forum it `s awesome!

As the registered keeper you are held responsible for any tickets incurred regardless of who is driving. The process for making an appeal still rests with you to begin with https://tfl.gov.uk/modes/driving/red...representation . Unpaid tickets are referred to the Traffic Enforcement Centre which is basically a rubber stamping exercise but still legal. If you have removed any clamp fitted to the vehicle you do run the risk of being stopped for driving a stolen vehicle which will also invalidate your insurance. The Bailiff has taken Control of your vehicle and it is now the property of the Court until payment is made either by you paying - including enforcement fees - or by being sold at auction.

Plodderton, is JustAsk too late to appeal? If so, I suppose your advice is to pay up before things escalate still further?
Even if if there is going to be an appeal, it's best to pay now, I guess?
surely, the driver had all the details he needed to pay the PCN if he wanted to? He could have just paid it at the reduced rate, and none of this would have happened.

The Common Law states that unless the Court procedures are followed to the letter.Which is obtaining a Court order as per the procedure and not pretend to have one without even going to the courts.Plus the fact that "you cannot charge money on a land not owned by yourself as an individual or a company therefore all the Councils and Agencies like these cannot charge any of us unless they have the ownership of the land that they charge for the use of?"This is the Common Law as I understand it..am i wrong?If so what is the law rekating to these matters?
Otherwise what`s the purpose of all these forums and discussions if we have no rights what so ever but are just unnecessary noises in the night so it won`t matter whatever they can practice lawful or unlawful?

The trouble with your approach is that the authorities don't agree. They'll happily fine, ban, or even jail you, whatever you think, and they have the muscle to back up their point of view.Last edited by 2222; 28th November 2018, 12:02:PM.

The only escalation there can be now is removal & sale + auction costs - best guess £500 on top of the £310 already charged - will need to be a vehicle worth at least £5k.

surely, the driver had all the details he needed to pay the PCN if he wanted to? He could have just paid it at the reduced rate, and none of this would have happened. If the driver is going to admit to the "offence" and subsequently sent the ticket then the only way this can happen is for the RK to authorise someone - but it tells you that on TfL site.

Thanks again for the advice but no can do..
At the end they came to my way of thinking and allowed me to pay around 10 per cent of what the Bailiffs were asking as they could see that I was right.If not I would have gone to Court and get a Court Order for much more than what they tried to get it from me since it is easily done by themsleves anyway.I d have instructed the Bailiffs too as they did.
Just a word on rights;sometimes you have to fight to get it,not just lie down and take it.
