  • ES Parking, case struck out :)

    Hi Guys,

Just a quick update as I got some help with this CCJ claim against me from this forum.

today I received a letter from the court stating the case has been struck off. If I read it correctly ES will have to pay a further fee and provide detailed evidence of why I owe them
    £160 including the contract.
I'm fairly sure they cant provide any evidence as the sign was a prohibit rather than an offer of contract.

Hopefully I read it right . I have attached the files for consideration.

The case isn't struck out, only the particulars, so they have to submit properly pleaded particulars by 9th December, at which point you can submit an amended defence in reply.

If they fail the case should be struck out although there doesn't seem to be a direct sanction in the order.

OK, cool. I will wait and see if they provide some decent particulars.
If they fail to present by the 9th will that be the case over?

I wonder why it took the court nearly a month to let me know of the stiking out of the particulars?
