  • county court claim

hi all, I wonder if you could advise, please.

I am at court next 16th, as the claimant to my case.

I have been advised that I need to make a written statement for the judge in the morning with things I want to make a light to the judge from the defendant's witness statement.

is it a written statement I need to call it?

    thank you

If you're replying to the defendants witness statement then you can file and serve a supplementary witness statement - if you're expanding on your points of law it would be a skeleton argument.

Sounds like you want to do a supplementary WS now so it's with defendant and court - and prepare yourself notes for the hearing covering what your argument is just to help you put it forward on the day.

what it is, the defendant device dates and etc doesn't match the truth.

I was advised from personal support unit, that i need to enlighten the judge on the dates, then give this to the clerk or usher the morning of the court case.

but what do i call it?

also you saying about notes, would that include these dates?

Sounds like a Skeleton Argument, ie the points that will win you the case so that the judge knows what to expect (and can do his homework). So you put in what your arguments to prove your case will be. But concisely and briefly, you expand at the hearing

Can I just check something? These dates are crucial to the claim? Or you are just pointing out some inaccuracies?

Did you file and serve your own Witness Statement ? and did that contain the correct dates, from your point of view?

i didn't have any witness statements, only emails and fire service reports.

All my dates are correct, with emails and reports to back mine up

On your letter from the court that gives you the date for the hearing on the 16th, was there an order to exchange witness statements ( normally 14 days before ) ? and if so, did you send anything to the court and the defendant before that date ?

Have you written and sent to the court and the defendant your own witness statement? To introduce new evidence on the day of the hearing is frowned upon by the courts.

all my information has been sent to the courts and defendant.
                          I don't have any further.

however, the defence is saying that no work was required and the witness is saying work was required but doesn't know why the work wasn't completed.

the morning of the 16th I wanted to highlight the judge of that information before court
