  • Builders coming on to my land/garden

    Hi I am a new member,my new neighbour is planning to extend his garage which will extend right up to the party line.I cannot see how he can do this without builders coming in our garden and removing the fence, are they allowed to just come in and work my side, without my permission,any help would be appreciated. Thankyou.

      Whats the problem with giving them permission? Talk to them agree that they can work on your land providing they agree to a few simple rules

            Hi,thanks for replying,we have a nice garden with a various bushes and a largish size tree which would all removed/cut down, thanks

              Have you discussed their application with them at all and told them of your concerns regarding your bushes and tree ? They may be able to put your mind at rest.

                Well you could be neighbours for a while so I would suggest tact and diplomacy first. What has already been suggested in the time should be spent talking to the neighbour and builder and maybe even the planning officer about your concerns would be the first step. I would even hesitate talking with the planning officer unless there are time issues pending because you don't want to influence planning until your concerns have been confirmed. You do need to know your rights and how to enforce them but only if they don't seem to listen or act upon youre concerns.

                  Hello again, just found out the plans have been past, can anybody actually tell me my rights about builders coming on my land,they are building an extension right up to the boundry and less than a metre from our tree.There is a party wall act 1996 but am not sure if it applies to us ? as we have a wooden fence on the boundry. We cannot understand why they can build a wall /foundations so close to the boundry with a tree there, we did mention this in our objection.Please can anybody help, thanks.
