    Advice needed

    I sold my house via social media 11 months ago
    Agreed a price but they struggled to sell, two estate agents late and modern auction .. they sold but I terminated the contract with them after loads of problems
    The buyer from months ago made enquiry regarding how it works etc and stated they couldn't afford more than X amount which was below the starting bid.

    He said it was conversation not an offer, as we had already agreed a price months back .

    They are named on the contract with the sole selling rights .. but my argument is that they agreed to a sale 11 months ago and it was not introduced via them

    Okay....

    You agreed a sale with a buyer in November 2017, however the sale fell through as the buyer couldn't sell their own property.

    You then, say in Jan 2018 instructed an estate agent with sole selling rights under contract.

    The estate agent put it to auction and the propety sold ?

    During the auction process the buyer from Nov 17 made an enquiry about the auction and stated a figure at less than the starting bid.

    Presumably that offer was not accepted ?

    But now you have accepted an offer from the same buyer after terminating with the estate agent ? ( and the offer is the same price agreed in Nov 17 ?)

    The estate agent wants their commission as they 'introduced' the buyer ( via the auction enquiry ) - but your argument is you already had the buyer before instructing the estate agent, they'd just taken time to sell their house to be in a position to buy ?


    Might be simpler if you can do a timeline for us please.

    And do you have a copy of the contract with the estate agent.

      Its hard to understand what your saying/asking. theres not enough details
      crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even
