    Hi ,I am looking for information regarding a claims company who will be taking my partner to court for fee's. In February 2018 we received approximately £2,950 at which time they wanted almost £900. They said we would recieve the cheque and should pay them once we received the £2950, for some reason we forgot about it. It was brought to our attention in a strange way, we were contacted in July 2018 by the same company saying they could get another £3000, so we said okay go ahead. two weeks go by and our bank sends a letter saying we had a payment in feb' and there is no more due to us. so then the claim company says you owe us £900, my partner asks why seeing as you haven't got anything, He then says you owe it from February. We had no reminders, we had no contract and no contact at all until July when they said they could get another £3000. Will I have to pay them or are they trying to worry us into paying them? I think someone made a mistake by not chasing the fee and used the promise of another claim to try getting their fee.

      Can you say who the claims company is?

      If you obtained a refund in Feb 2018 following work done by the claims company for you then they are quite within their rights to invoice you for the commission amount due. They would have up to 6 years to claim this from you. Presumably the commission rate is 30% incl VAT or 25% plus VAT ?

      Some companies are going back on PPI payments that have been succesfully reclaimed and seeing if there is a further amount due to the customer due to undisclosed commission ( Plevin is mentioned a lot )... so it may have genuinely been that they investigated whether that was the case.

        Hi amethyst, the company is called claimhunters. we used the money for part payment of funeral expenses for my partner's dad. So we haven't got the money, will the courts or claim company want payment in full or would I be able to get some sort of payment plan ?.

          You agreed to the payment so the claims company are entitled to it and could successfully take it through court, with some added expenses added to it. Why not approach the company, explain that you have financial difficulties at the moment and can you pay of the sum at, say £xx per month. They will probably say no, we want £yy, a higher sum so pitch your initial sum at a sensible sum that is lower than what you can afford to allow for the uplift.

            As per Ostell you will need to make an offer to pay at an affordable monthly rate. They aren't obliged to accept but if you make a reasonable offer it should put them off taking further action and adding further costs/fees.

            The amount they are asking for sounds correct - before 10 July 2018 the agreement was for 25%+VAT to be charged.
