  • Charge on property

    Where a charge on a property exists, for example, of £25,000, what is the minimum and maximum the lender/holder of the charge can legally demand?

    Also, I can't locate the court case/transcript regarding Barclays misselling of Shared Appreciation Mortgages. Please advise.

    Which court case/transcript are you looking for ? As far as I am aware it hasn't been through court yet ( the last attempt for group litigation got stopped at the first hurdle, there is a second attempt ongoing I believe but not sure how far it has got ? )

    You had a SAM for £25k ? How much is the bank saying the amount due is ?

      You are correct - I forgot. If I remeber correctly, wasn't some kind of pre-trial judgement granted (I'm not a solicitor) in Barclays' favour?

      The question re the charge is nothing more than stated (public forum, paranoia, etc.).

        ahhh okay. The previous ruling that BArclays appealed and won seems to have been against permission for a Group Litigation Order and it couldn't be appealed further as the GLO group didn't have the funds to do it. Not sure if the actual ruling is published anywhere though I'm afraid. There does seem to be talk over the last year or so about another action but I'm not privy to the details at all. There are a number of law firms involved by the look of it ( from a quick google search ).

        The charge secured will be for the loan amount but it secures the agreement, basically. So if say you took a SAM for £25k and the amount to be repaid was £100k then that's the amount they can demand / call the charge in for.
