Hi I am looking for some help, in June 2017 I bumped a car on a roundabout, about there was no damage to my car but I gave my details to the other driver. When I got home I called Swiftcover to let them know what had happened. I heard nothing more until I received a letter from the DCBL explaining that £900 needed to be paid for the damage to the other guys car. I contacted Swift cover they said that the letter was nothing to do with them. At this stage I had no idea what to do with the DCBL letter contacted citizens advice for some help and said that I needed to send a form to high court saying that the CCJ needs to be put on hold. I heard nothing until the Bailiffs arrived at my flat demand £2496. I paid it by credit card because they would leave without any payment. I have had one payment of £350 as compensation but nothing else. Whilst all this was going through all this I had to purchase another car, but because the CCJ was still on my credit file the interest rate I was charged meant that I paid additional £2k on the car. Swift cover havent taken any responsibility for all this but i am the one left with all the stress of this and a poor credit rating. What do I do I feel that they need to pay for all this. Please can you help me.

DCBL are the bailiff company?
Did you give the other parties details to Swiftcover ?
What form did you send to the high court? Do you have any copies of paperwork you can post up at all ?
What is the compensation for / who is it from ?
Had the other driver sued you privately rather than go through his insurers ? Did you receive no details of his claim or court documents at all ? Just something from bailiffs ?
IF so then you'd have needed to apply to the county court to set aside the judgment and suspend the warrant... which CAB should be on top of so not really sure what's happened with this, it sounds awful for you though. ( ahh it was HCE with the warrant - still should have gone to your local court with a set aside - did you send a affadavit that you didn't know about the 'debt' maybe?)

It certainly seems that the third party initiated court action against you.
It could be that he had the vehicle repaired at his own expense and claimed from you (or he might only be estimating the cost)
As you received no notification of the court claim you were unable to defend it.
Your insurers were also not informed about the claim against you.
Must say it sounds a bit odd.
Why would he not claim against your insurers? More certain to get paid if he wins than claiming against an individual!

I would SAR Swiftcover to see exactly what they knew.
I don't trust them as a company, having crossed swords with them on daughter's behalf a few years back
