Land Access Rights

Mine and my adjoining neighbours properties (terraced) are leasehold but, as specified in the deeds, we all have shared access and parking rights to a small patch of land at the rear as well as vehicle access to through a short driveway which runs down the side of one of the end terraces. 11 years ago another neighbour whose house lies to the other side of the driveway erected a gate to his rear garden, using this and the driveway to move his large vehicles in and out. Neither myself or adjoining neighbours have yet appealed. Does this neighbour, therefore who didn't originally have a right to the land, now have access rights? Thank you.

Have you seen that neighbours deeds that he doesn't have access rights over that driveway?

I believe that to obtain the access rights it would have to have been used continuously for 20 years.

Has an issue arisen regarding use of the driveway ? Is he blocking it preventing others from using it ?

Hi

He probebly doesnt need rights, as long as hes not blocking the acsess for anyone else and the gate and fixing dont block anyone when not in use. It all depends on the exact wording on the plans/deads, also, the local area plan migh have restrictions in it ( vehjicl sizes )

Can you post up the wording on the deed, it has to be exact wording.

One other point, who owns the freehold of the land over which you have access rights?
