  • QDR/ZZPS/one parking solution-Help please-

    Hi there, I received a parking fine on my university campus. Stating that I did not display a permit. My permit was displayed on the dashboard. Anyway, I went to the university and told them about the fine and they stated that they don't usually enforce these fines so I should just ignore it. I was writing my dissertation at the time and was very stressed so took their advice and ignored the fine. However, now I am getting letters from QDR solicitors stating that I have to pay £162 and my case is in the recovery process which means I cannot appeal. Now I feel stupid for believing the university about ignoring the letters. What are the chances that my case will go to court and what can I do now? can I still appeal? There is no photographic evidence on the one parking solution of my car. Should I request these first?

    Any advice would be great.

    So you edit so that the identity of the driver cannot be inferred.

    What wasa the paperwork ytou received, especially the Notice to Keeper.

      The paper work was firstly from ZZPS limited asking for money and then from QDS. They already knew my name and address as they stated that they got all my information from the DVLA. QDS is instructed by ZZPS limited to contact me regarding the outstanding fine. I just kept ignoring the letters as instructed by the university but now I am starting to worry.

      How do you edit the identity of the driver when they already know its me. I think I still have the original fine. Would QDS have the photographic evidence of my car when the fine was issues? I really do not want to go to court over a parking fine. I know I displayed my permit but have no evidence of it.

        ZZPS are debt collectors and do not own the debt and therefore cannot instruct anybody, including QDS, to take action in court. Who does the letter from QDS actually ask you to pay? Therein may lie a hint as to who actually wrote the letter on a "borrowed" letterhead.

        Again, did you receive a notice to keeper?

        You remove the identity of the driver from the forum. Use "the driver....." etc.

          The letter head is QDS. They have asked the driver to pay £162 to them. They have given the driver a website https://paymentsplace.com/qdr to make a payment online or to ring their office number to pay by phone. Sorry If I am sounding really dumb here but what is the notice to keeper? All letters were addressed to the owner of the vehicle who was the driver when the fine was issued.

          They have stated that this is a "Letter Before Action"

            For someone at university you seem to have a knack of not reading or understanding the advice !! You were requested to remove any hint of who may have been driving and yet you ignore and repeat. The letters were addressed to the keeper of the vehicle using details from the DVLA. How would they know the owner?

            A notice to keeper, possibly parking charge notice, is the letter from the parking company to the registered keeper asking for payment or identity of the driver. Have you got a copy of this?

              Would it be worth while ostell asking for photographic evidence of the alleged contravention of the driver ? I'm guessing with a permit parking situation it's not so easy so say 'I don't know who was driving' if the permit displayed was for a particular individual ( who also happened to be the Keeper ). So ' The Driver would contend a valid permit was displayed and thus no contravention, send photographic evidence...' ?? but that relies on you admitting who the driver was I guess?

                A letter to the keeper was never sent just letters from ZZPS and QDR on behalf of the company.

                  Loath for them to ask for photos of the alleged contravention as they will believe if they send them then the invoice will be paid.

                  Photos of the signs might be a good idea to see if they are forbidding, ie permit holders only but no offer to non permit holders.

                  If they do not know the identity of the driver then the key to all this is the Notice to Keeper, where they obtain the keeper details from the DVLA.

                  For information QDR solicitors were formerly Quantum Debt Recovery. At least one of the directors is also a director of Wright Hassell solicitors. They are trying to confuse matters by using different names. Here's the link. So in that payment page you linked to Quantum Debt Recovery no longer exists.

                  I think a simple no liability BOGOFF letter to them as there has been no notice to keeper within the required time.
