    Is it illegal to draft a particulars claim for someone who does not know the format and rules of the high court? i want to open up a consultation firm to assist those who do not know and don't have money to pay for a lawyer

    I'd suggest that if you do not know the answer to this you shouldn't be advising or drafting anything legal for anyone.

      There are certain activities that are known as 'reserved legal activities' which means that you have to be an authorised person to carry out those activities e.g. solicitor, barrister etc. These reserved legal activities are stipulated in Section 12 of the Legal Services Act 2007 but details of those activities are contained in Schedule 2.

      From memory, I don't believe that drafting Particulars of Claim falls within any of the reserved legal activities although one might argue that it could be deemed conduct of litigation. I would probably disagree on that point but if you put your name to the claim form and signed it then it would most definitely fall into the conduct of litigation category.
