Hi,

Sent a CCA Request & SAR Letter on the 3rd August 1st class which they would have received on the 4th August but i have yet to have a response - Should i do anything else or do i just wait??????

Well, the SAR was 30 days to respond, so you could chase that one up - the CCA request they are in breach of so the debt is unenforceable at the moment ( it's temporarily unenforceable until they find the documents - but no need to chase that up)

So send a follow up SAR letter threatening to go to the ICO. I'll grab a letter example for you

On 3rd August 2018 I sent a formal Subject Access Request to your company requesting copies of the data about me that I am entitled to under data protection law relating to any and all accounts / agreements / debts which you may have control of. This should include and communications with third parties about me, transaction lists, agreements, letters, screen notes and any recorded telephone calls you retain.

Despite your having received the request on 4th August 2018 I have not yet received a response. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month. You have neither acknowleged my request nor asked for more time to deal with my request. As you have failed to do so you are in breach of Paragraph 45(3) of the Data Protection Act 2018 and as such I expect the data to be provided within 14 days or I will be making a formal complaint to the Information Commissioner.

If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.

I sent a follow up SAR letter on the 4th September (1st request sent 3rd August) but have not heard anything back also i have not heard anything from them regarding CCA request which was sent on the 3rd August - so they have not responded to any of my requests, Do i just wait so see if they do send me anything?????

I received a letter from Link yesterday it was there when i got home from work - i sent them a SAR follow up letter on the 4th September as they had not responded to my original request sent on the 3rd August and have now received a letter from their complaint department, they still have not sent me anything regarding the CCA & SAR request i sent them on the 3rd August - i have attached their letter and follow up letter i sent, Do i now just wait 8 weeks as in their letter or do i need to send them something else - Any help/advice would be greatly appreciated
