JBW are chasing for a debt that is not mine. I sold my car in Dec 2017 I have provided evidence of sale, letter re insurance stopped, letter from DVLA saying I don't own car (didn't on date of offence) I have been told by them this morning their client will not accept my evidence I completed a TE7 &TE9 and the court has refused my application. JBW are threatening to attend my house and remove goods to cover the debt. please advise what I can do

Okay when was the offence ? Was it after the DVLA had been informed of the new keeper ?

Did you receive and appeal the original notice ? or did you only find out when JBW got in touch ?

Had you changed address between selling the car and the offence?

Were you advised of a court hearing & did you attend if you were?
Sorry i'm just thinking out loud, it might be irrelevant, I am not employed in anyway in the legal profession, please ensure you research any advice I give before using it I have been known to be wrong on multiple occasions.

This is a debt regarding an unpaid Dart Charge accordingly, there is no court hearing as such. Neither is there a judgment.

I am surprised to hear that your Out of time witness statement was rejected by Highways England. You mention that you provided evidence of sale, letter from DVLA etc. Was this evidence provided with your Out of Time witness statement or was it provided to JBW?

PS: It is NOT the court that refused your application. It would have been Highways England (who administer the Dart Charge).

That was what I was very clumsily alluding to, but wasn't sure.
