    image_30506.png Hi everyone. I am trying to sort out my partners historical issues. Please can someone help me identify if this reply from Halifax for a CCA is acceptable. My partner remembers very little as he has been using Eurodebt for his debts and has got nowhere trying to find out about the origin of all his historical debts.

    You have left your telephone number on the agreement

    Firstly
    Without knowing if the name and address are correct it is difficult to say exactly but

    1) I think it is illegible but that may be the scanning
    2) If this was a CCA request, were there defaulted terms and conditions and a statement of account - these things should be sent together

      Also, whatever anyone says, it is really only a Judge who can say if it is irredeemably unenforceable or not - not all judges act the way we think they should

        Thank you so much for replying. I am not using that number but the names , d.o.b, telephone number and gross income is all that was on that application. Everything else is blank. No bank account, no job nothing. Also it looks like they copied and pasted the boxes with the signature and the agreement and right to cancel. They just look like they fixed them there.
        they sent me separate t&c with different addresses.
        the statement of account was just a writing saying you owe xxx amount and xxx amount is due. That's all. No history in transaction nothing. Not even a date on expenditures and balance. I tried to ask them for a SAR but they are claiming they need me to provide them with further addresses I have lived on.
        I will see if I can remove the post with my old phone number. Thank you so much for replying.

              Is that the entire agreement they've provided? In it they refer to condition 8.2 but there's only condition 1 etc there - did they send a set of full terms ?

              The inception terms should be at the address you lived at when you opened the agreement

                Hello Amethyst. That is how that document came saying they have sent an application form plus the previous terms and conditions those make up the CCA. Those other set they sent one of them was at a more current address but the other was matching with the first address on the application letter. I am sleeping in at work this evening but I can try to upload those two others when I get home.

                  There was no signature on any of them. They look like they were reconstituted even though the debt was 2005

                    So today they sent me a new copy with the correct address please help me look at the letter and the statement of account plus the new current t&c. however still no sensible statement of accounts. Just telling me this is how much you owe does not help me. I want to know if there were fees on the account, the transactions that led to that amount e.t.c. I cant do that just by that one statement of theirs.I am very thankful to you all for your time. I have managed to upload the whole thing! super proud of myself. Now if only I can learn some law to save my family!!!!

                        yes, they sent 2 copies one with the same address as the application letter and the other with a different address. when I asked which was which then they sent the one I attached in the previous message. I have attached the first documents they sent me with the * to identify them

                          Okay cool it's the DOC003 one then that goes with the application front page. Can you read more on those short terms to be able to compare with the DOC003 ? From what I can see it does look right ( £25 charges, reference to 8.2 - I cant make out the interest amounts to compare though) --- although there is a question whether you did actually have those terms when signing the agreement - seems they'd have been in a separate leaflet judging by that first page they've sent the scan of.

                            You mentioned earlier your partner was with EuroDebt - is that MoneySave solutions ? using them to run a DMP through Atlantic ?

                              Yes it was called Eurodebt then paragon and now the last mails we got from them they were calling themselves moneysave solutions. I have made a Sar request to them but they have refused to reply. They just went quiet.
                              I have also sent a SAR to halifax but they have ignored it.
                              I have a communication from Halifax in 2015 ( collection and recoveries) where they were requesting a payment from his account and the balance on that same account is different. So when they say the account was charged off in 2009 how come they were requesting for that token payment in 2015.
                              that letter gives the account number, repayment amount and plan arrears
                              the interest rate 21% for the terms they have sent differ from the starting ones at 19% i dont even know why they made up other t&c in 2009.
