  • Two County Claims from BW Legal - PCN for stopping ?

    Hoping for some help guidance with TWO PCN claims .
    Both by VCS mobile camera car in Wakefield
    Can anybody point me in the right direction please..Thks

    How much ????? Can you post up suitable redacted copies of the PCNs. Leave dates. Photos of the signs would be helpful. Modify you pot so that the identity of the drivers cannot be inferred. Use "The driver ....."etc.

    Are these claim forms from Northampton? Has a Letter before Claim" been received?

      Proof wise, they will ( probably ) have camera footage taken seconds / minutes apart showing the vehicle in the same position in a no stopping zone.

        VCS try this at airports and have "No Stopping" signs on the verge. Can't read the rest of the writing so no way they can create a contract.

        Where was this? AND MODIFY THE POST AS REQUESTED

          Thank you .. will post all the info I have and modify .. It was at Calder park in Wakefield ..the driver pulled over to check a flat tyre and the other driver had stopped to for a passenger

            Frustration of any alleged contract springs to mind. You forced to stop by matters outside you control. Can you show you had a puncture by having a bill for the repair?

                  No, please provide a link to the location using a copy and paste of the details in the address line of your browser. Then we can wander around to look at the signs etc. You still haven't edited your first post.and #5 needs attention.

                      Yes this is correct - one car stopped were the artic is been repaired - it had a puncture . but this cannot be proved and the other alittle down the road where the passengers got out due to illness.
                      I realise there is no supporting evidence other than what we say - Punctured car shows hazard lights and drivers door open ?

                          That PCN is old, why has it raised its ugly head again?. That PCN is not POFA compliant and therefore they have no claim against the keeper, only the Driver at the time. Here's POFA As there was no windscreen ticket then paragraph 9 applies. 9 (2) states the items that MUST be in the notice to keeper to hold the keeper liable and many of them are missing. 9 (2) (f) is not there, similarly 9 (2) (h) and 9 (2) (a) Stating that they will assume the keeper was driving is insufficient, they have to show who was driving at the time, and you are not required to tell them,.

                          The charge is for the breach of conditions. How is it possible to read those signs and conditions when driving past? There is no contract offered so there can be no breach. The charge is a penalty.

                            this is the other PCN ... does the same apply ? Scanned from a Xerox multifunction device001-page-001.jpg apparently BW are going back over there records it seems - I am aware that a few people have recd the same from 2yrs back - is there not a time limit ??

                              Similar reasoning. For the puncture you could not complete any alleged contract because of circumstances out of your control. The helper was assisting a disabled car and had no intention park or create a contract for parking.

                              They have not complied with the requirements of POFA (which is really intended for parking, not stopping or waiting) and can only take action agaisnt the driver. They know this but hope you don't. The keeper is under no legal obligation to identify the driver at the time. 2 years is a long time to remember who was actually driving.

                              Unfortunately no time limit, only the 6 years limitation.

                              They have become emboldened by the attempts at liverpool to go to court.

                              Have they just sent these PCNs or are they just debt chasing?
