  • Yes Car Credit PPI Claim

    Good afternoon Yes car credit has reared its ugly head again got a letter in Dec 17 saying that they owed me PPI filled all paperwork in Jan 18 offer to reduce final balance only no actual refund in 07 I was fighting them in County Court as a defendant the district judge at the time tore them apart was knocking off all fees charged on the case . Then they served a notice of discontinuance. That was the end if the matter till last year 11 years on. Looking for advice as to my next steps agsinst this bunchbregards

    If the refund was for PPI that hadn't been paid originally then it would just come off the outstanding amount. So really it depends how much you had paid and what proportion of that was PPI. The debt is statute barred and they can't now come after you for the remaining balance. It doesn't sound like you won in court, the claimant discontinued during court proceedings? ( at the hearing where the judge said about the charges being removed did he give them chance to go away and come back with further evidence on that ? and they then disconitnued? ) so the debt still 'exists', and is just statute barred.

      I have all my original paperwork the Ppi is clearly mentioned on the agreement they used the value of my old car as a Ppi deposit even though they told me it was off the balance of the finance we were told we had to take the insurance as it was part of the deal or no car at the time I needed a car . They were given time by the judge to come back about the charges but then discontinued the case. They admitted in court that all the sales people received commission on the in usance sales . Is this worth making a complaint to the financial ombudsman regards

        You can make a complaint to the FOS if you aren't happy with the outcome of your complaint against YCC, but you will need to complain to the company first about their refunding the PPI to the 'debt' - I think as you haven't actually made a complaint and it was a refund instigated by them ( or the FCA told them to ) you might have to make a complaint to them.

        Have you got a copy of the letter where they state they are refunding the PPI directly onto the balance of the debt?

        Were the court proceedings brought by YCC directly or a third party / debt purchasing company ? Had you already returned the car or had it reposessed ? Any idea how much the original finance agreement was for and how much you paid / what the court claim amount was etc?
