    Hi,
    I am new to site and would like some URGENT advice please, today 23/12/17 I have received letter from Lowell, it says “notice of issue of warrant of control” issued by county court business centre, Wolverhampton, says I have to pay £408 by 6.1.18 or bailiffs are coming, I haven’t to my knowledge received anything from them before this letter, I had a jd williams account about £5 yrs ago and couldn’t afford to maintain payments due to personal reasons at my oldaddress.i ansingle parent and youngest has specialneeds, I can’t afford to pay this in one go and certainly not by 6/1/18 it’s on white paper any help/advice would be much appreciated please x I’m worried sick

    Hi , There must be a CCJ against you for that old catalogue debt. Does the warrant of control have a claim number on it ? You should give the court a call and ask for a copy of the claim and judgment, then you have a couple of options.

    You can complete the N245 form to suspend the warrant and make an offer of payment at a monthly affordable installment - this will cost you £50 - unless you are eligible for fee remission ( form ex160 )

    that will I’ll put the warrant on hold and the court will look at your income and expenditure and order payments - the ccj will stay on the register and on your credit file for six years from the date of judgment

    or you could look at applying to set aside the judgment ( as it was in default ( you didn’t receive it - was it at a previous address ? ) this costs £100 if the claimant consents or £255 if not but again you may be eligible for fee remission. This puts the claim back to the start so you can defend it.

    If if you can check your credit file it may get show on there so you know amount and date of judgment.

    Do you remember much about the debt ?

      And try not to let it worry you over Christmas. The 6th January has to pass without payment or contact or application for them to start any bailiff action so you needn't be worrying about bailiffs appearing over Christmas. But obviously the sooner you decide what to do the better and you can get that application in to the court.

      Defence wise, it really depends on the debt, when did you first open the catalogue account do you know? was it online ?
      Did you move house between opening/defaulting and the claim date ? And did you tell the creditors / update your address on your credit file and the electoral roll etc ?

      Also how is the rest of your credit file and will a CCJ on there for six years be a big issue for you?

      ( also who is the claimant ? )

        @Amethyst thank you for the advice, I haven’t had contact from jd Williams for years, this court thing has come out of the blue can’t remember A lot about the debt. Haven’t had anything off Lowell since now x

          Hi Amethyst, claimant is jd Williams, I don’t remember having anything from them ?? My credit file is poor, so wouldn’t be an issue �� the forms you have mentioned do I need take them Court in person or could someone take them on my behalf ? Getting very worried and stressed now x
