I am splitting up with my husband, he refuses to leave the family home and wants me to leave. He is thinking of giving up his job so he can get social. I want to go but not loose my share of the house. We have two children in education. One wants to stay with me and the other with his dad

Hi Julieanne, Sorry to hear you are going through a tricky time with your husband at the moment. How old are the children? ( just as in education could be 5, 13, or 18... and makes a little difference re them making decisions )

I think he might have a shock if he tries giving up work to live on benefits....it's not the easy joy of a life people seem to think it is ... Plus the children might end up wanting to stay together when it comes down to it.

Is the home owned, on a mortgage, joint owned? or private rent / council rent ? If so what kind of tenancy do you have and is it in joint names ?

Do you have somewhere to go ?

Our mortgage is in both our names.
I have 4 children, three live at home 21,16,14
