    Hi All

    Just after a bit of info on a letter i received from a DCA.

    i had a credit card some years ago. i defaulted around 2003 and made token payments for quite a few years. About 2 years ago i received a notice of assignment from the bank to cabot.
    after reading on here about cash cows i sent my cca request off and was told the usual 40 days story from cabot. then i received a letter from them stating they cannot provide the cca but will continue to try.
    i decided to stop paying and heard nothing for a year or so.

    then last week i got a letter from them for which i am trying to find out what it means.

    letter is 5 pages, 2 information pages from the FCA regarding arrears and defaults,
    1 page stating "notice of sums in arrears"
    1 page stating "default notice"

    and main page stating corrected notice of sums in arrears, explaining the bank did not send a correct notice of sums in arrears and we are sending this to you so you have all the correct information.
    then asks to contact us regarding payment.

    is this just an information letter or should i be worried?

      It should be just for information but may mean it has come back up on their radar. However the rules haven't changed and they still need to provide the Credit Agreement under s.78 CCA 1974 to enforce, so until/unless they do that I wouldn't worry and just file that letter away.

      You stopped making payments in 2015 you think, so statute barring is a way off, when you received the assignment from the credit card company to Cabot and sent off the CCA request ? The token payments up to that point, were they made direct to the credit card company ?

      What credit card is it? ( it may mean some people are refunded an amount of interest charged over the period the bank failed to send the arrears statement out - unlikely to affect you as you defaulted before 2008 so won't have been being charged interest in any case)

        Hi, Yes all token payments were made to the card company. the card was either lloyds , lloydstsb or tsb i cannot remember exactly.
