If you get 5 mins check out companies house web check service . Interestingly the majority of the Notice of assignments that Asset collections send out are dated 21st June 2016 which co-incide with the date that TM Legal services created the Charge over Asset collections.
It would appear that they are unhappy with the CCJ terms & conditions, they want the debt paid earlier.
Not sure what you can do to rebuff, I hope other beagles have positive ideas,

        Re: Tm legal

Well, once a judgment has been handed down that is it, unless it allows for a six monthly / annual review specifically the amount set by the court stands until/unless one of the parties applies for a variation. Even if the judgment is assigned properly to another party the original terms stand unless there is a formal variation.

There is always though the opportunity ( if the judgment holder is open to it) of making a partial settlement in full & final to have the CCJ marked as satisfied on the register and credit file if need be. Can help a little with things like a mortgage application if you're two/three years into a CCJ.

Of course, if the original judgment is a 'forthwith' order, and hasn't been paid, the judgment holder is able to go for enforcement via charging order / enforcement agent/ attachment earnings at any point. Also on an installment order if you did miss any of the judgment payments they could, as lin found, try to go back to court to enforce - which is why it is imperative you keep good records of payments and always keep on top of them, pay well in advance if at all possible. It isn't unheard of for a judgment holder to 'make a mistake' - and if you end up in court defending an application to enforce, you will need to take your evidence that payments were made on time every month/week whatever with you to show the judge ( I learnt that the hard way about 10 years ago !)

          Re: Tm legal

Hi again we'll still getting threats from Tm legal had a new letter saying that I have left my employers not true ! Since ccj issued and ignored their letter and ones court sent ?? Not received anything from the court?
Can I ask if I have not missed any payments that they can ask me for new finiancial details when the sum of £5.00 was set and accepted monthly
I'm worried about bailiffs as national debtline told me they can send bailiffs without going back to court to vary ?? Is this correct because I was in the understanding that if I wanted to change amount I would have to pay and apply for a vary application surely they would have to do this also ? Any advice would be appreciated

            Re: Tm legal

You contacted the court before and they said there had been no applications made on the case at all. Is the letter the same as previously ?
Did you write back to them before? If not we should respond... Have you got a copy of the original judgment order? and evidence of all your payments?
Are they still harrassing you on the phone too ?

Did you get the appointment with CAB ? any help?

                  Re: Tm legal

They can't if the judgment is for installments at £5 a month. Yes call the court in case they have put any application in in the meantime. They don't even own the debt - what are the emails saying ?

If you can find a copy of the judgment it would be useful to be absolutely certain it is an installment order and not a forthwith order than CAB negotiated to be paid by installment.

It is judgement for the claimant acceptance says 5.00 a month on or before this date until the debt has been paid

                    - - - Updated - - -

It says at bottom to the defendant you have made an offer of payment which I did when sending court forms that I could pay which the claimant has accepted says nowhere it can be varied

Hi lin66, Just wondered if things had settled down now or if you were still getting letters from TM Legal ?

There's another case with similar which is putting together a formal complaint to the LEO /FCA and wondered if you wanted to do similar to help show it's not just a one off mistake that they send out these letters....

examples... (bear in mind this case hadn't even got a judgment )

                        Email 12th October )
Your County Court Judgment is currently pending an application for Bailiff Action via the means of a Warrant of Control.

A Warrant of Control authorises Bailiffs to attend your residential property to collect monies owed and/or to remove goods to settle the outstanding balance.

The Bailiff does not have to show you their authorisation before entering your home.

A Warrant of Control is valid for twelve months from the date of issue. This time limit can be extended by a District Judge.

The application for a Warrant of Control will add additional fees on your outstanding balance.

Following our previous correspondence, as of today your account has been transferred to our Specialist Enforcement Team.

The Specialist Enforcement Team are looking to confirm your status of employment, living situation and any assets in order to determine which route of enforcement we may go down. This could result in further fee’s being added to your account and possibly Bailiffs attending your property.

You still have the chance to arrange payment of your County Court Judgment and in turn, avoid Bailiff Action.

                          Hello

I know this is an old thread but searchers may be interested to know the following about TM Legal Services.

So today I have worked out that they are actually a debt collection agency who like to make themselves look like a solicitors only.

Asset Collection actually sells them the debt.

The problem with this is, they arnt actually registered with the Financial Conduct Authority, so therefore they are breaking the law.

I have today reported them to the FCA and have told them I wont be dealing with them as they are breaking the law.

                            Hi Rebecca,

Unfortunately they are an ABS http://solicitors.lawsociety.org.uk/...rvices-limited with a Solicitor. But no they aren't FCA regulated and act on behalf of Asset. There has been mention of them buying the debts from Asset although I haven't actually seen any solid evidence of this ( no assignment etc ) so if you have anything it would be helpful..... The claims in court are brought by Asset with TM legal acting. Complaints over TM Legal's behaviour to the FCA has to be regarding Asset and their 'control' over the third party rather than against TM themselves, however an SRA complaint about TM legal's behaviour ( harrassment ?) would be in order. TM only deal with claims that have already gone to Judgment ( in a chasing for payment respect ) although sometimes it seems Asset send debts over that haven't gone to judgment yet, thus putting TM in the firing line directly for being unauthorised by the FCA for consumer credit debt collection. (Once a claim is under a judgment it's a judgment debt, not a consumer credit debt )

So it hinges on the specific complaint you have really.

this is right, i had the same thing recently, it seems they do indeed buy the debt from asset, and then seek to collect it.

This one is from a case where there wasn't a CCJ so there is a complaint in with FCA, and LEO

But in cases where it has become a CCJ before 'sale' from Asset to TM - do TM have to be regulated to collect on judgment debt ?
