  • Money Advice Trust response to MOJ's Limitations Consultation

We would suggest that three years is a reasonable time span of operation in the modern, technologically-advanced world. We would also suggest that such a period would be of benefit to the clients of NfP advice services, who are often vulnerable, that matters do not run on indefinitely. A speedier resolution would provide less opportunity for repeated passing on of the debt from one collection agency to another and repeated resale of the debt. Equally, continued pursuit is clearly a waste of time and money in relation to people who are unable to pay.

Could they not mention the selling of Statute Barred debt or was it not within the consultation parameters?

I don't know as the MOJ haven't published the original consultation document that I can find - they do mention selling debts on 'close to' the end of the limitations period. I would think trade in statute barred debt would increase massively if this changed.
