    I had a loan with Welcome Finance in 2007 and 15months into the payments, they called me and pestered me into topping up my loan. Unfortunately, I fell for it. They cleared the loan with the top up loan and gave me the balance. Both loans had PPI although I didn't know that the first loan had PPI at the time I took it. As for the top up loan, I definitely knew that it had PPI because I had told them I was scared that in the event of anything, I wouldn't be able to keep up with the payments and that's when they told me that they would add PPI. After making one payment, the unfortunate happened and I lost my job. I told Welcome finance that I had lost my job and they wouldn't take any of it. At the same time I struggled to pay rent and my child was ill. I told Welcome Finance to apply for PPI just as they had done for me in the first place and they wouldn't listen to me, all they wanted was money. Because they put me under so much pressure, I offered them £10 per month and I was told by their manager that they were not a charity organization asking me why I took out the loan yet there were the ones who pestered me into it. In their communication log submitted to court they have admitted that I offered £10 per month although they don't mention what happened thereafter. They have also admitted that my ex-employer told them that I no longer worked for them and yet Welcome Finance were not processing PPI as per their promise when I took out the loan. Any help would be appreciated. Thanks in advance lovely people.

    Would you have the PPI documents ? Some PPI doesn't pay out for a certain period after taking it out.

    When is your hearing and have your submitted your income/expenditure and witness statement ? Are you defending or making an offer to pay ?

      The The PPI says I could claim 30 days after taking out the loan and it was after that period when I lost my when I lost my job. I am intending to defend the claim because I offered them £10 per month month and they refused. Also there is something like unfair relationship between the creditror and the creditor and debtor under the amended consumer credit act 0f 2004. The relationship soured after they refused the £10 per month offer.

        A creditor should give due consideration to an "reasonable" offer if the debtor is known to
        be in financial difficulties, but the rejection of an offer does not mean unfortunately that the
        creditor cannot recover the debt.

        A Judge will take an offer made into consideration but then has to decide it on the " balance of probabilities "

        you owe the amount claimed.
