    hmm if they are winding down it's going to be difficult to enforce unless the court really move their arses on it.

    might be worth a chat with, if you mention Eric, Cartel and the FOS - and also mention about how the court system really isn't geared up to enforce FOS judgments..... could be a nice two pronged story ?

      If I've done it correctly I've been told it's 5 days to process and then they have 14 days to respond.

      It does frustrate me that if the fos hadn't said they'd chase them from the start we could've probably had this in the courts before the fca decision.

        Exactly, and if the FOS and the Courts had ever bothered to communicate about the enforcement of FOS adjudications you'd have had the warrant weeks ago.

          We have our court order!! Not sure whether it was because of my extreme bumpf that I sent to the court but we have it.

          I'm now trying to find out when I can send the bailiffs in haha

                Here is the Court order. It's called an Order for recovery of an award.

                The form I used to apply for it was http://www.acas.org.uk/media/pdf/o/f/n322A.pdf

                When you go through it it becomes clear as you have to state the FSMA clause and there's a space on it to do that.

                The form isn't that difficult. I just sent loads of stuff with it to cover it (reading that article made me think at least if I send it all then they can't say it's wrong).

                I posted the form last Thursday and it came back yesterday so the turnover is really quick.

                As I said, I'm sure I read somewhere that you have to allow them 14 days to settle or come up with a way of paying and then you can get a warrant.

                  That's what I wanted, it will be very useful if anyone else finds themselves in your position and the court and FOS are completely utterly useless. If they hadn't been so useless you'd be done and dusted by now, rather than in the position that the company is 'winding up'.

                        It means they send the order to Debt and Claims / Grassroots and they can apply to have it set aside (same way you can apply to set aside a CCJ- ie overturned.)

                        They don't have a hope though so I wouldn't worry about it.

                          I don't think they are winding up. I'm under the impression that they are just closing their debt management part. When I tried to phone them (ages ago) they had taken all the Debt management options from their phone list thing but still had the PPI stuff.

                            I was just going off of the email from dear Mr Fairweather

                            Mr Fairweather's response was as follows
                            Thank you for your e-mail and I am sorry that you find yourself in this position. Unfortunately since the FOS made their decision we have voluntarily surrendered our debt licence to the FCA and sold the book. We are thus no longer writing any new business and our only income is from debtors who pay monies due. There is no money on the account and unless the debtors pay, this position will not change.

                            I do understand that you now have the right to instigate legal action if you so wish.

                              Possibly. Who knows. Will be interesting if they try to use that excuse with the Court not to pay. Surely without them going into administration they cannot use the excuse of waiting for other people to pay them before they pay us. They must still have assets.
