      The ban will now be included in the new Government's Freedom Bill in November and is likely to come into force next year. It means the rules in England and Wales will be the same as Scotland, where clamping is already banned.

      Private clampers will immediately have their licences revoked, effectively putting them out of business. Continuing to operate could lead to fines of up to £5,000 or a possible five-year jail term.

      The ban will apply to private land only. It is already closely controlled on public roads
      and car parks. Landowners such as small businesses and church halls who want drivers to keep out will be expected to fit gates or barriers.

      Where cars are abandoned or left in a dangerous place, the landowner will be able to call on the police, who will be given new powers to tow cars from private land.

        By parking and thus ignoring the warning signs the offending motorist has entered into a contractual agreement to pay a parking charge. We operate our collection procedures under the Administration of justice act 1970.
        DVLA CODE OF PRACTICE FOR PRIVATE PARKING ENFORCMENT:

        The company adheres to the DVLA′s code of conduct to ensure lawful ethical and fair business practice when obtaining the offending vehicles keeper′s registration details for the purpose of enforcing parking charge which remain un-paid.

        Be interesting to read the governments actual proposals for the freedom bill, assume they will be released later ?

          As the DVLA have recently discovered in respect of SORN's they DO NOT make the law AND contract law does not allow a land owner to penalize a motorist UNLESS they cause damage or other genuine loss. In addition assuming the DM is correct the ability of these firms to obtain the personal details of motorists from the DVLA will end

            Haha Well I took a day off yestarday from work, thought I would enjoy the sunshine, Turns out I GOT CLAMMPED, I live on a street and if you had a day off and parked there they would ticket you even if you where on the allocated parking spaces section. So yestarday got up looked out and ....I was clamped by the council, also just to take the michael, when they used to ticket people it was always residents and not the fools who used to use it as free parking for days out everyday i get home and people are taking up our spaces!!! Ridiculous now, I have to pay Release fee or risk fine going up. Its in query with them at the moment, does that mean it on hold??
