Response re complaint from OFT to Nattie ....

Consumer Credit Act 1974 (the Act)
Complaint Against: Government debt assistance and Debt help, debt advice, debt management & IVAs

Thank you for the information you have provided in your email dated 3 August 2009.

The OFT continually considers the fitness of licensed debt management companies and their advertising, and one of our considerations is whether a trader has engaged in unfair or improper business practices. Where we have evidence of this, we can take steps to revoke the licence, or we may issue a warning letter to the trader putting it on notice that its behaviour, if repeated, may call into question its fitness to hold a licence.

We also run sweeps of adverts generated by debt management companies on the internet and in newspapers (both national and local) throughout the UK. Under Part 9 of the Enterprise Act 2002, the OFT are unable to discuss any investigation that it may or may not be undertaking against a trader, this includes being able to confirm or deny whether an investigation is taking place. You can find details of any published enforcement action which has been taken against traders on the Press section of our website http://www.oft.gov.

The website domain names you have mentioned below have been recently brought to our attention and I can confirm that they are not covered by a Consumer Credit Licence. We are therefore considering this matter and will look to take the appropriate action.

The OFT has issued guidance to consumer credit licence holders engaged in commercial debt management. The guidance is intended to ensure that debt management companies treat debtors fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants. You can view our guidance at:
The Office of Fair Trading: Debt management practices

We have therefore noted the details of your email, and we will consider this alongside any other information we receive with a view to any consumer credit licensing or other action we may decide to take.

Thank you again for writing to us and bringing this matter to our attention.
            #staysafestayhome

Any support I provide is offered without liability, if you are unsure please seek professional legal guidance.
