im acting on the basis there is no point in waiting around for him to do something. im still acting in good faith as ive not been shown a will that has either been probated, in 3 years, or been proved to be an original copy. he could sit there for years saying he has a will bla bla. until its probated its a piece of paper.

Well if you are determined to continue you need to write to your SB requesting he accounts for what he has done with your father's effects and money.
Advise him if he fails to cooperate you will go to court to obtain an order that he does so, as well as seeking to gain a possession order for the house.

I cant see him suddenly coming clean on this. that's why I have continued to pursue the insurance and bank. once they see im serious hopefully they will contact him and insist he does probate.

regards the bank trying to wriggle out with there indemnity, whats the next course of action?

I would suggest a strong letter to them pointing out that they should only release the funds to the properly authorised person, ie the one who has letters of administration.
Their decision to release the funds to a person not bearing the court's authority is their concern and not yours.
Accordingly you require from them a full accounting of your late father's account, and payment to yourself of the balance at the time of his death.
Failure to comply will result in you seeking a court order forcing them to comply.

the police have contacted me now and are asking for all the background info.
it seems a local PC, who has been tasked with this via the PSD complaint.

ok as if things couldn't get any weirder this week. the insurance is now saying they never paid out and that I will be getting a cheque in the post. looks increasingly like the will is a fake and that's why the insurance wouldn't pay him out without probate.

well over 2 months on and no contact from SB or the probate office. starting to wonder what hes upto. the police have decided as there is a potential will involved they cant act.

As I suggested back in April, apply for possession of the house.
You are registered owner and have Letters of Administration.
Force his hand and see how genuine this will is.
All that is happening at the moment is you are getting wound up wondering, and he is sitting in the house sticking two fingers up!
If that will was genuine why hasn't he gone for probate and reversed the land registry records?

the FSO are apparently going to ask them for more info then contact me within 3 month!!! with a case advisor. shouldn't hold my breath then. apparently I had to wait for there final response, which as we know was balls we aint giving you the money back.

p.s. on the will front. as crazy as it seems not to reverse probate, at one point we thought it was crazy to think he might have some sort of will.

I believe everyone who didn't have an avatar now has the puppy as a default (kinda cute IMO )
