  • Where does the money go?

    My brother in law left a sum of money to his two sisters when he died, the rest went to various charities.
    If one of the sisters should die, before his estate is settled, where would her share go? The charities?

    Do you mean the sister dies after your brother in law dies but before the executors pay out your BiL's estate?

    The general rule is that the sister's share would be paid to her estate to be distributed by her executors in accordance with her Will or the rules of intestacy if she has no Will.

    It would be possible for your BiL's Will to make a different provision for what happens and could include a 'survivorship' clause so would need to see your BiL's Will to be sure.

    The rules are different if the sister died before your BiL.

      Brother in law died in 2024 his sister is still alive aged 95.
