  • Left money what happens to that money should I die before probate is sorted

    My wife has been left a sum of money by her brother [who passed away nearly 2 years ago], what happens to that money should she die before probate is sorted out etc.
    We ask the question as we are both in our late eighties.

    If your wife dies before her late brother's estate is wound up and paid out the share to which she is entitled would form part of her own estate and would eventually be paid to her executors and distributed in accordance with her Will (or the rules of intestacy if she does not have a valid Will).

    Two years is long time to wait when the beneficiaries are in their late eighties. I would be asking the executors whether they will be making interim payments. If there are complications in finalising the estate executors can, and usually do, make payments on account if there is sufficient cash available in the estate to do so. They don't have to wait until everything is sorted out.
