Hi, I made a new will last year leaving my house and assets to my 2 sons who live with me. My youngest son age 37 has Autism "High functioning" and works 3 days a week in a charity shop .As he's on means tested benefits, would inheriting our home and assets affect these benefits? I am 75 years of age. Any advice will be more than welcome.

Potentially yes. But if he won't need benefits, why should he receive them?

Personal Independent Payment (PIP) is not means tested. Your son may qualify for this benefit. The National Autistic Society and gov.uk provide advice about PIPComment

You could have had a Will that places the property in Trust so that Trustees (other family members or trusted friends) could administer the Trust assets as they see fit. The Trust asset in a Discretionary Trust is therefore not deemed to be owned by your sons. As already mentioned, seek advice from a good solicitor, preferably one that is STEP qualifiedComment
