Someone is going to need to see the terms of this trust. Answering the OP's questions without knowing more may end up not being helpful.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

Are you willing to explain what the trust is about, and how it arose?

In this memorandum, what has been appropriated and to whom?

                    Sorry for the delay

it says the executors have appropriated our interest in the property as a bare trust

OK, back to the beginning. You say the solicitor will not pay out. Has he said why?

I ask as it often helps to consider a person's reasons for his actions or inaction.

They say they are seeking their councils opinion but we believe they are stalling deliberately because they know they have to pay it out they always seem to make an excuse

If they are seeking advice from Counsel, that suggests that somewhere in this there is a dispute that you have not chosen to tell us about. Is that correct?
