  • Family home sale…difficult sibling

    Hi,
I’m sole Executor for my mum’s estate and been granted Probate. I’m one of 5 children and 4 of us want to sell our mum’s (father also deceased) house, Willed to us all, but one doesn’t. That sibling is capable of being difficult and is already trying to delay/sabotage any sale. We have offered to let them buy it (and buy the other 4 out) at a favourable price but they can’t afford to. The Will is very straightforward, stating the estate is to be shared equally, but there’s one phrase I would appreciate some advice

My question is, does “convert the same into money” basically/explicitly instruct me to sell the property?

    Thanks in advance.

As executor and trustee you have been given the power to sell the house. You do not need the agreement of anyone who is not executor /trustee.

Read the part above the first redaction.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf
