To get the residue distributed, I intend to accede to what I regard as extortion by my co-executor and intend to make a claim against her after the estate is distributed.

Is there any need to make such a statement to my co-executor ? i.e. would it affect my claim in any way if I did not?

If this involves you signing off on the estate accounts then you will lose any right to challenge those accounts on information available to you now after the event as you are confirming your agreement that the accounts are correct. Peridot ?

The claim that I would make would mainly be for damages for my share of the solicitor's bill above the initial estimate, which has resulted solely from my co-executor's harassment and other potentially criminal acts in pursuance of repeated unsuccessful attempts to reduce my share of the estate.

If I was dealing with a rational person I would would present my co-executor with a choice, but our costs would most likely keep increasing, and I feel confident that I would win a case on the evidence I have (based on the advice of a criminal solicitor) so would that be an option?
