  • Shares and 'holdings' question.

    Hi. I hope someone can help clarify a sentence in a will for me.
    The sentence is as follows: " I give to the said xxxx xxxxx all my shares and holdings of a capital nature in Halifax Bank of Scotland plc which I own at the date of my death".
    My question is - does this "holding" include the balance in the Halifax bank account?

    No. Shares and holdings of a capital nature does not include money in bank accounts, even with Halifax, and even if the testator had cashed in his share just prior to passing and put the proceeds in the bank - in that circumstance the gift would fail. It is literally just the share holdings owned at the date of death.
