  • Eon next

I had a tenant move out 2 years ago. Since march 2024 I started receiving txt messages from eon next. I received several phone calls asking to confirm my details. I advised the caller to send a bill or contact me by post. I have never received a bill. The text then jumped tov £1900. I have now received a letter from talc a debt collection agency demanding payment of said amount. Is this normal.

Of course it isn't normal. Tell them to stop it.

If the bill isn't in your name why did you ask them to send you a bill? How did they have your phone number to send texts and phone calls to if you weren't the occupier and it wasn't your account? It feels like there is more of a back story to this than you have posted.

        Hi Jones422

        Welcome to LB

Are you saying the tenant is responsible for paying the outstanding amount debt?

Energy companies will try to collect regardless of who actually owes the debt.

Send EON Next a Subject Access Request, get information on the 'billing'. Make sure you get Proof of Postage.

        https://legalbeagles.info/library/gu...ccess-request/

If it's the energy company's fault that they haven't 'billed' you correctly then 'back billing' may apply. Don't take it for granted that they are billing correctly.

Further to the above. I received a letter from BW legal on behalf of JC International acquisitions LLC, Who i assume have a purchased the alleged debt from EON next.. The letter offers a 30% if a payment plan is set up. As previously stated eon next have never sent a bill or statement. I simply received a txt in 2024 claiming I owe £1900. This is the first communication i have had regarding this matter since the txt messages in 2024. The issue with making contact with this company is that they will use it as an opportunity to create joinder and then claim i have accepted the debt. How can I owe money that has never been stated. no account number, no dates to and from. simply a property address and an unsubstantiated amount.

Where did you get that idea from? Sounds like FMOTL nonsense.

So I assume you didn't do what Echat11 recommended over 18 months ago and send an SAR to EON?

As you have not obtained any information about the billing it's not really possible to say whether you owe it or not. EON now appear to have sold it to a debt buyer, JC International Acquisitions LLC.

You can either ignore them and see how far they will go in enforcing the alleged debt, or you could send them a 'prove it' letter:

When to send a Prove It letter about a debt

You could send them a SAR at the same time, but send it separately.

If you decide to write send letters to JCIA with a copy to BW Legal and get proof of posting.

Have you checked your credit file with Experian etc? Is this alleged debt on it?

"opportunity to create joinder" - Where did you get this BS?

I have now sent a message to BW legal. I have not copied it to JC International as I have never received any communication from them. Eon Next i believe provided electricity to a property owned by me to a former tenant. Either EON Next failed to collect from the previous tenant or they are seeking standing charges for the empty property. Either way they have never sent an invoice or written demand merely a txt message to a mobile demanding £1900.

                Seperately joinder

                (ˈdʒɔindər)
                noun
                1.
                the act of joining
                2. Law
                a.
the joining of causes of action in a suit
                b.
the joining of parties in a suit
                c.
the acceptance by a party to an action of an issue tendered.

Upon proper execution, a joinder agreement legally integrates the new party into the original contract. The new party acquires the same rights and assumes the same obligations as the original signatories, or as specifically outlined within the joinder itself. This means the new party becomes subject to all provisions of the original agreement, including dispute resolution clauses, confidentiality provisions, and any other covenants. The joinder effectively amends the original agreement to include the new party without necessitating a full restatement or renegotiation of the entire document.

How else can anyone collect a debt from you that was never yours?
