hi, just received a summons from shulmans llp on behalf of octopus energy lmt for* energy they supplied, ive never had a contract with octopus but i think they took over a company that went bust a couple of years ago with whom i had a contract and had problems with billing i stopped my dd and switched companies this was over 2 years ago. i have no previous contact from octopus. the summons simply says i owe octopus. can you help?

Did you give a start reading to the new company ?

Be worth doing a SAR to Octopus and getting your first bill from the new company after you switched just in case there's an overlap of readings.

particulars of claim.

the claimant claims the sum of £920.67 being the balance due in respect of energy supplied to defendant by claimant. the energy supplied relates to property*******and was invoiced up to 16/08/18 .the claimant therefore claims the said £920.67 cc act 1984 the claimant also claims interest at the rate of 8% from 16/08/18 to 27/11/19 on £94.23 and also the same rate up to date of judgement or earlier at daily rate of £0.20.................

when i switched companies there was a dispute of wrong bills with Iresa energy supplier whom i had a comtract with and i paid by monthly dd But I stopped my dd once the dispute began - i never got any reply then the company went bust. and i switched to sse energy supplier in july 2018. i dont recal any contact nor do i have any contract with octopus, but it appears Iresa passed on my details and a disputed bill to octopus and they took over without contacting me nor offering me a contract. I was wondering if this is legal.

I dont owe any money to my other suppliers nor do i want a debt in my name and this seems not legal to just put someone on contract without their consent and demand a payment out of the blue.

What are we still tidying up?


193 customers have not yet received a final bill from us. These are all customers who moved to us on 1st August - but whilst they were with Iresa they had a meter exchanged which was not recorded correctly on industry systems. This meant we have had to do a lot of manual work to identify the meters, and these bills have taken longer to produce. We are working on these manually, one by one, and hope to get these out over the next couple of weeks.

Some complexity in paying refunds to customers for whom we only held DD details via Iresa records has meant delays. We believe we are now up to date with refunds, but are issuing cheques to some customers.

We are also aware that there are some customers who left Iresa before the 1st August, and were never sent a final bill by them. We were not passed any information about those customers from Iresa systems but we're here to help if you think you are affected. If you are one of those customers, please contact us on the email address below.

Definitely worth sending the SAR ( Subject Access Request Letter ) to Octopus - dpo@octoenergy.com

to see what happened.

Then we can put together something requesting more info from Shulmans. Get the claim acknowledged and the SAR sent off first though.

Don't contest jurisdiction - just acknowledge with intent to defend in full - don't go on to enter your defence, that will come later once you have more info.

I have had no previous communication from Octopus Energy, have never entered into any agreement with them and am not aware of any monies owing to them.* I would be grateful if you could provide me with further information, to include invoices/bills up to and including 16 August 2018, copies of any assignment notices, original contract/agreements between Octopus and myself, any previous letters and pre-action communications as these have certainly not been received at my current address.

hello, I have received an email from shulmans with some repeated invoices for a period of 01/05/2018--29/08.18 with an estimated reading, a customer and account number.I have not received any contract as i never had one nor signed nor agreed one, they claim this is an internet account only and was passed on to octopuss by Iresa without any of my knowledge or consent. I have also now received a letter from them stating that a county court judgement will be entered against me and i should contact and pay UK search limited.I have not received any contact from Octopuss nor Iresa.
