    Scottish Statutory Demand - BW Legal / Lowells. Help please.

    Hello.

    Just like to say hi to the forum as I am New to all this as most people must be.

    I had a "Appointment letter for Statutory demand" from WalkerLove delivered on Sat 18th Jan 2014 via the mail, this was dated the 15th Jan 2014.
    the letter was to let me know that someone will attend my home address on the 20th Jan 2014 between 2pm and 4pm. Two old looking guys turned up around 2pm and popped the Stat Demand through the cat flap, hmmmm.

    I had the Halifax card in 2000 - debt is over £3K.
    No Notice of Assignment served either.

    I have attached the sent forms which I am not sure about at the moment, I will be sending a CCA of first thing in the morning for any information, So do I hold off send the denial slip off until I get the information back from the CCA request?

    Hope anyone can help, I have been reading through all the threads since Saturday and know a little more that I first did.

      Hi Border Collie.

      I last paid the Halifax back in Approx April 2010, then Blair, Olver & Scott took over, I never knew about the CCA at the time so I ended up paying £50 a month B,O & Scott up until early 2011 then i found out about the CCA, I then sent a CCA to B,O & Scott in Jan 2012 and never had anything back, still have the letter sent and the postal proof. CAB don't tell you anything.

          Additionally I'm afraid Celestine is unable to deal with Scots claims. If you get the CCA request sent off that's a brilliant start, it sounds like they have taken steps to enforcement action despite being in default of your 2012 cca request and that should be enough to enter denial. Unfortunately I don't know very much about the procedures on Scotland so you may want to see if you can get advice from a solicitor who deals with sequestion on a regular basis.

            As a Scottish solicitor can I offer some basic information in relation to this. If a "statutory demand" has been served on an individual as a preliminary to seeking their sequestration (bankruptcy), then this can be defeated for the price of a stamp. The demand should have appended to it a "denial slip". Completing this and sending it back to the creditor before the demand expires will render it impotent. This is not to say that you will evade bankruptcy altogether but rather that the creditor will then usually be forced into alternative action against you which will usually be much more long winded and expensive for them.

              Excellent - Thanks for the explanation Mark; which will no doubt come as a huge relief to these Scottish recipients of statutory demands from Lowell Portfolio.
              What do you make of the 'extra page' Walker Love seem to have included in these demands? Naughty? Misleading?

              I can assure you, many English recipients would dearly like the Scottish rules to migrate southwards!

                What excellent news. Another kicking for Bowells. Personally I would recommend anyone posting anything to the Leeds Threat Centre send it by at least recorded if not Special Delivery. The Leeds Losers have been known to be economical with the truth and may well deny receiving any denial slip. I would have called them Liars but that may be libellous (allegedly)

                      HI. Thanks for all the information etc. I had sent off for a copy of the CCA on the 21 Jan 2014 and received a reply from bwlegal on the 25 Jan 2014 (dated 23 Jan) saying thanks for request etc, but the bottom paragraph goes as follows.

                      "We will seek to ensure that the information you have requested is provided within 12 working days, however this is contingent on receiving the documentation from your Original Creditor within the aforementioned timescale."

                      is this how it works as there does not seem much point in the 12 days +2 that are allowed if they do not stick to it. I will still send the SD back so that it arrives before my time is up.

                          It's actually a UK thing. It used to be an offence not to comply where as now it means little unless you are close to trial.
