Ok there's no major hurry as you only had the claim yesterday but send us everything you have together with a timeline of events and put your username as the subject.

Hi guys
I am also in the same situation as everyone here and I have received the court date. I was wondering if anybody would be willing to write a letter for me saying the same thing has happened to them? I would like to use them in my defence.
Should I be successful in court, I willI also pass on the documents and I have used for my defence to Amethyst.
Any help would be appreciated.... X

Thanks scammed, have got those emails. You don't have a court claim yet do you ? Have you heard anything from them since 27th Jan ?

I'd like to be able to do something before a court claim comes, but you already know any letters are simply ignored, as well as the company adding further charges to the 'invoice'.

If there is a letter which is a LBA ( ie the we will bring court action next letter ) then we should respond to that, otherwise it is a case of ignoring.

could be deemed an LBA - but I think you already replied to that one and they haven't submitted a claim yet. ( despite saying they would at ''After 12 noon today'' )

Ha ha just re read that last letter...

After 12 noon today our compliance team will proceed with the committees instructions and lodge a UK Services & Support Ltd vs xxxxxxxxxxxxxxx case with Her Majesty's court where by we will also be seeking reimbursement for the £25.00 issuing fee and claiming 8.0% per annum on the £xxxxx as permitted by the Courts of England.

It appears they are charging the court fee twice.

Once before issuing the claim - they add £25.00 (including VAT apparently) to the amount they are claiming as a ''OPENING COURT CASE CHARGE'', and then in the claim form they add COURT FEE £25.00 to the claim ( which happens automatically )

Presumably that is argued as their admin charge ( on the list with their abusive language charge).

But still something to be aware of.

I spoke about that with Tom. The ''OPENING COURT CASE CHARGE'' isn't the filing fee to the court but their own fee to the customer for filing which obviously isn't one of the types of fees listed in the overdue charges menu even though they state on the lists of actual charges that:

Okay, thinking about 'testimonials' - I think it would be a good idea and helpful for the court defences if everyone wrote a witness statement which can be used for everyone elses case. I'll speak to Tom about that on Monday and put a ''template'' of a Witness Statement together which we can then (in VIP) keep in a bank of evidence for others to use in their cases.

It would be things about how you found the website, how it misled you, how you are a reasonable consumer etc. I'll suss out exactly what can go in it but I think that would be really useful.

It would need to be on an anonymous basis - on the forum - but the actual Witness Statements for court would have to be identified and signed with a statement of truth. So it does need thinking about.

It could also assist in making a bulk complaint to TS, ICO and HMPO etc ?

Thinking out loud really so any thoughts would be welcome on that.

Did they send you the pretend court claim in the end ?
