I called Skoda to cancel my PCP on 21st of August and was told that I would hear from BCA within 7 days.

It's now 29 days later and I have had no contact from them.

The car has been sitting at my local Skoda garage since 25th August - the original email I received from Skoda told me to keep part 9 of the V5 and send it back to DVLA and they provided the details. I sent this back the day after they emailed me this information and there was nothing on the email to say that I had to wait until the vehicle had been collected.

I have received notification form the DVLA that I am no longer the registered keeper and also the car is no longer taxed.

They also told me that I had to keep the car insured but surely that's unfair to make someone insure 2 cars for this length of time and I have also cancelled my direct debit as I have read elsewhere that I am not legally required to keep it active. They have taken 1 payment since I exercised my right to VT and I didn't want another one coming off.

Is there a timescale that they have to keep to before I can wash my hands of the situation and the ownership falls to them and I need do nothing else - or do I need to wait this out?

As you are not the registered keeper any longer I wouldn't imagine you need to keep it insured as you won't be driving it. It would be up to them to insure it as they're the keeper now.

If the car is at a Skoda garage then perhaps you should cancel the insurance too given the timescale where they have not contacted you.

Perhaps you should send them a letter stating that as they have not repsonded, the vehicle has been left at the Skoda dealership and give details of that address. You've also cancelled the insurance and changed the V5C details so that they are now the registered keeper. They've had a reasonable time to collect the car and if they choose not to then it is not up to you to make sure the car is taxed and insured, they are the owners of the vehicle and it is their own responsibility to ensure it is taxed and insured.

I believe the car would be insured under the dealership anyway if it is on their land. Send a letter and keep receipt as proof and/or send an email confirming the same so you have evidence they were notified.

I think @R0b will confirm that having notified Skoda of VT, and having handed vehicle back it is the finance companies total responsibility.
If they fail to collect it, that is not your problem.
To avoid possible future problems over condition did you take dated photos of the car inside and out ?

Firstly, thanks for the information it has been very useful.

I picked my new car up immediately after dropping the old one off and there was a period of 24 hours when I was insured for both vehicles so I don't have insurance on the old car currently.

Is email communication as official as a written letter?

I have all of the email correspondence I have sent and received from Skoda or should I still go ahead and write a letter to them?

Email is fine and it would be prudent to let them know the current situation, so that there is clarity and no doubt as to what is going on and where the car is currently sitting.

I have received a response to the email I sent a couple of days ago from Skoda finance.

They have asked me to contact British Car Auctions to have the car collected. They have also told me that the car should continue to be taxed and insured until it is collected.

This is my response to them:


Thank you for getting back to me regarding this.


I'm sorry but it is not my responsibility to call BCA, it is yours to provide my details to them to contact me as it should have been 30 days ago.


Secondly, I was advised to send section 9 of the V5 back to DVLA. It was not specified that I had to wait until it had been collected. As mentioned in my previous email I have already done this and DVLA have informed me that I am no longer the registered keeper of the vehicle. As I am no longer the registered keeper the vehicle is no longer taxed. By law I cannot tax a vehicle if I am not the registered keeper as I need the V5 to enable me to do this which will have been sent to the new owners so it is up to them to tax and insure the car.


I am also not going to be insuring a car that I am not the registered keeper for either, nor am I insuring 2 cars for a month (so far) because someone hasn't done their job properly.


Also, as mentioned in my previous emails, I was advised that I could drop off the car at my local Skoda garage which I did on 25th August at 4.30pm. I cannot be held liable for a car that has been handed over to a garage and sat for 4 weeks as I have not seen it since this date. The garage have the keys, V5 etc as advised and may have moved it somewhere else.


This is the first time I have done this and with all due respect, you are the experts. I have done everything asked of me so the failure to have the car collected, to tell me to wait until the car had been collected to send the V5 back etc rest with your company.


Unless you are able to confirm that I am no longer liable for the condition of the vehicle and able to return the extra payment I made to you after informing you of the VT then I will have no option but to seek legal advice on the matter.


I have kept all correspondence including the sole letter received earlier this week as well as all email communication I have had with your company.


I am not prepared to wait any longer until someone finally does something. You have failed in your obligation to honour and process my VT as requested on 21st August at 8.10am, exactly a month ago to the day.
