Just a few points.I am the registered keeper but car is not at my house. No arrears on the payments as have paid 50 per cent.Have informed the h.p company& they told me they would pick the car up as ex has no choice as it is in my name. The car at the start at dealers was for her use as she had bad credit hence i got h.p on car but was going to pay me the monthly premium but to no avail.I have sent my ex a proof of posting that she is to be held responsible for wear&tear& excessive mileage.Hope this clears a few issues up

I think you're spot on let the HP provider take it from here, she has been formally advised on the collection and that she is liable for any costs/charges arising from her usage of the vehicle.

If there are subsequent costs you may have to litigate to recover them if your ex refuses to pay.

Just received a letter in the post from peugeot saying i never paid last months instalment.want a cheque for £4,375.00 in 7 days.I phoned them & told me they have not picked the car up from ex partners house& has re- sold the car in February which she had no right to do.AS i am the account holder i am liable,it has taken 11 months for them & nearly 5 months to pick up the car, what a shambles.

The car company are correct of course as you are the account holder solely and any informal arrangement between you and your ex about paying half each isn't their issue. However you informed them of the car being at xxxxx address back in November and informed them you were handing it back to them and they were to collect. Your ex sold the car ( which was on HP and didn't belong to her in any way) in February. That's 3 months after you VT'd. They didn't try and collect it until March ? and they haven't informed you of any of this until almost a year later.

Was anything in writing about the VT and collection of the vehicle ?

Yes was writing about Vt but not collection of vehicle but that was just over the phone i did a proof of posting letter on 19 th november 2014 to my ex telling her the vehicle is now cancelled& must cease to use it immediatlely. You must deliver up all the keys ,documents regarding the car to hp company on collection of vehicle& you will be held responsible for any wear& tear claimed by the Hp company.

I am worried they are trying to turn this into a voluntary surrender where the OP will be liable for all sums not yet due

                            This is important

Did you get anythng back from the finance company accepting the VT in writing ??

They usually do not collect vehicles as it is an added expense. They get you to drive it to the nearest aution house within a reasonable distance

I think the finance company have been stringing you along

Your greatest obstacle will be lack of paperwork from the finance company, i fear at this moment you are still liable for the contractual payments on this vehicle

All i got back was a letter dated 15th november 2014 .Thank you for getting in touch to ask about ending your agreement& returning your vehicle.ending your agreement early - liability quotation on another page.I had already paid. 50 per cent of the car off so no outstanding finace when i terminated.

The thing is you have not officially done a VT until they arrange an inspection of the vehicle, that is normally done at the auction house. Your liability then ends the moment you sign the car over to a representative of the finance company

From requesting a VT and surrender of the vehicle should take no more than 14 days
