  • Voluntary Termination car on HP with Specialist Motor finance

    Hi everyone. Just looking for some help with my current situation.

    In 2022 i took out a HP agreement on a car and i am now £170 from the 50% marker to VT the agreement. Yesterday i e mailed them and also send a recorded delivery 1st class to SMF notifying them that i wish to Voluntary Terminate the agreement and have asked on how to proceed in returning the car.

    I received a e mail back today to call them to discuss the process which i did. They have insisted that i need to fill in the VT information pack and also have to sign it as well as download and do the images via the app they want. I have said i have already notified you of my legal right to Voluntary Terminate the agreement but they insist that if i dont sign there information pack form then they wont accept the VT!!

    Having viewed it this what they want me to sign ;


    "I HEREBY VOLUNTARY TERMINATE THE ABOVE GOODS ( my agreement number and vehicle reg )

    I UNDERSTAND THAT I WILL BE RESPONSIBLE FOR ANY LIABILTY OUTSTANDING IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF TEH AGREEMENT.

    I CAN CONFIRM THE FOLLOWING ITEMS ARE AVALIABLE UPON REQUEST

    V5 DUCUMENT
    MOT CERTIFICATE
    FULL SERVIVE HISTORY
    ALL KEYS

    I ALSO CONFIRM THAT I WILL EMPTY THE VEHICL OF ALL PERSONAL POSSESIONS EFFECTS AND CLEAN IT THOROUGHLY INSIDE AND OUT PRIOR TO DELIVERY OR COLLECTION

    DATE ;

    I have also said i can pay the extra £178 that would bring the account up to the 50% total payments made.

    Any advice please ? She has said to go have a think about it and let them know. I have a feeling they up to something but i am just being paranoid?

    1) Attached is a voluntary termination Information pack – please read.



    2) You will need to take photographs of your vehicle inside and out – this is done using the Go Appraise website:



    3) Go on Specialist Motor Finance Website: Car Finance Providers | Hire Purchase | Specialist Motor Finance (smfmotor.com)

    • Find the Customers tab.

    • Click FAQs on the drop-down menu.

    • Then click on “Questions about your finance agreement”.

    • Then click on “Can I Voluntary Terminate my Hire Purchase agreement?”

    • Follow each step listed on the drop-down menu. Read carefully and fill in the requested field.





    As discussed today, we will not be able to proceed with the Voluntary Termination until the attached form has been signed and returned to ourselves.

      Welcome to LB

      What you should do is 100% take pictures / video etc so there is no comeback.

      Your letter should be sufficient, below is a letter and excellent Guide.

      What you could do is ask them where in the Terms and Conditions does it say you have to fill in their forms to terminate the agreement.

      If they carry on saying you need to fill in the form, and your letter won't do, then tell them you want to lodge a formal complaint, follow the complaints
      procedure on their website. But make sure you make the final payment.

          I have paid the remaining balance of £178 that they said I needed to in order to bring it up to the 50% mark .

          I have also e mailed and challenged them regarding where in the T+C's does it mention anything about filling out new forms and signing in order to process my right to Voluntary Termination of the agreement .

          how long should should I leave it before raising a official complaint with them if they do not reply ?
          or should I try calling them and asking ?

            On the phone they can give you any 'old tosh', they have training in reading any 'old tosh' from a script.
            Give them 10 days, but you should hear within that time.

              Yes very good point indeed .

              I will leave another 10 days and see what they come back with if anything . the next Direct Payment is due out in 10th September so won't cancel yet as heard that can cause a lot of issues till the confirmed .

              am pretty sure will have to go down the official complaint route as they were very insistent about having to sign their voluntary termination form otherwise cannot go ahead with it .

              I will check the helpful templates link guide out and see if can use something from there to help my case .

                      but still referring me to the website for the completion of their extra forms . See e mail below

                        Email them, that you want to raise a Formal Complaint.

                        They are still telling you to fill in the forms, but not telling you where it says that in the 'Terms and Conditions' that you have to fill them in.
