rejecting a car on hp

    so they have finally responded to my email and i think they are going to try and fob me off again... this is what they have said so i'm worried about the call. can i just say to them unless they have an offer for me or arrangement to collect the car i dont wish to speak with them and leave it to the courts?

      Do not agree to anything that reduces your claim. Get a confirmation that any offers will later be confirmed in writing. If you can record the call. This cannot be used, it's only for your personal use but it would enable you to produce a transcript.

        double posted sorry. i doubt they will even offer me a claim but i will make sure i dont agree to anything and i always ask for a written copy too.

        i have a call recorder on my phone aswell which is a bonus as i have a few conversations from them recorded now.

        if they are fobbing me off again should i just confirm the claim to the court come monday?

          ok so they have rang.... she said it seems i am entitled to reject the car as it 'seems' the fix has failed. but apparently they still need this independent inspection done on it, i gave them permission 5 weeks ago to inspect the car and they keep saying they will be in touch to arrange and nothing... grr going round in circles now

            Go right back and tell them the further delay is unacceptable and they have till 4.30 pm Monday to make a satisfactory offer.
            No offer + initiate court action

              As you require a car for work give them a choice of paying for a hire car while they deliberate and delay payment or else they will pay for your loss of employment because of lack of transport. I thought payment had to be as sson as possible and in anycase within 14 days. They can inspect when they have picked up the car.

              Just wind up the pressure

                ok so they rang friday and have arranged to come and see the car on friday 3rd august which is this coming friday.

                is this wrong should i not of allowed it?

                  Email them back and tell.. them they are welcomed to inspect the vehicle any time, but remind them you rejected the car under your short term rights in March (check date) and in view of this further delay you not only require full repayment as previously advised, but also damages which you will quantify in due course as you find their continuing delays unacceptable.

                    i didnt actually reject the car in march though, the car was in for repairs from march - may. i did obviously make it clear that the car was not fit for purpose.

                    is there anything i should do when this inspector comes.... should i video him?

                      right iv done some research and im really not happy with the 'independent' company they are using to inspect the car. theirs 30+ reviews saying they are bias to whom has paid them and the only 5 star review is off the director of the company the company is ACE automotive consulting engineers in bradford.

                        Did you send the email? and did they respond?

                        Re the inspector; just take photos(dated) of the vehicle from every angle possible.
                        Be ready to argue that any blemishes were either present when delivered, or occurred when in the hands of repairers.

                          yes emailed them stating id made them aware of the faulty car on 10th march 2 weeks after delivery of the vehicle. suprise.. no response from them

                            so...the inspection has been done... the car threw up plenty of codes but the only ones i could get hold of were P200A and B1325

                            the inspector agreed that the car had an oil leak on the driveshaft and that that there's a rattle on the engine. he also agreed with the knocking on the steering.

                            He said he was putting these down to present or developing at the point of sale but we will see as their company has terrible reviews about them lying in reports etc.

                            ah also the inspector has broken the drivers seat and now it rocks back and forth


                            guess its a wait and see for now until the report comes through

                              Start working out how much this car has cost you directly eg taking it to garages for repair, cost of inspections etc. so that when they make an offer (which you may or may not accept) you can make a claim for damages

                                hopefully they will make an offer.....should i get some quotes for drive cleaned aswell?

                                how long should i wait before chasing up with the finance company for the report?
