    Dear M1, I sent you an email yesterday as I have trouble with the forum due to issue with pop up blocker. Please can you advise me on my appeal. The document is too long to attach. In short I received a PCN from parking eye, my appeal with them was rejected, I have appealed to POPLA and Parkingeye has responded to that appeal. I have one last chance to respond to their defence before POPLA will make the decision. Please can you see if I am fighting a losing battle or if there is anything else I can add to my defence. I don't have much time as need to respond with next few days.

        Appeal via Popla

        Dear Mystery 1,

        Sorry for the email, but I hope you can help me with my parking fine. I have tried to follow your advice on the forums and appealed to Parkingeye and then when they rejected my appeal I appealed via POPLA. I have received correspondence from them they sent in response to my appeal via POPLA. Please can you let me know if you can help me with your expertise in preparing a response to this, or let me know if it's a waste of time. I have to respond within the next 5 days and I am unsure what to say further.

        Your help will be greatly appreciated, thanks in advance.

                      Nothing further to add that i see. I'd wait for popla to decide as they don't appear to deal with keeper liability other than stamping their feet and saying it complies.

                        So there is definitely nothing more I can add to strengthen my case?
                        Is it likely that I will win the Appeal? They are relying on the beavis case which they won and I as I understand it the lost his appeal at tribunal. Which really is a shame. Also, despite my request they only provided a redacted copy of the contract with landowner which I cannot even read.

                        I hope they they don't win as I really cannot afford it. If POPLA rule in their favour I assume I will have to cough up the £70 as that's the end of the appeal stage?

                          You should win and i see nothing to add that hasn't been said.

                          Beavis is a pain and negates unfairness but not keeper liability.

                            I forgot to ask, do you think that POPLA may ignore some of my appeal due to its length? I hope that I haven't drowned any important points because it's too long. I tried to cover every angle so I hope that nothing is dismissed.
