  • MET parking charge notice, Mcdonalds Heathrow South Hayes

please help we parked at Mcdonalds and had dinner etc, while we waited to park in a long stay airport car park. I did not see any notices. now after returning from holiday 3 weeks later we have been sent a parking charge for an over stay of 38 mins, apparently the max stay is only 60mins.

we have a young child and after the usual performance going to the toilet etc we obviously went over the time limit.

what should I do? it says if I pay the notice early it will be only £50. otherwise £100. the date issued was 6/8/2015.

what should I write? I saw an outline letter from mystery1 in another thread. should I use that?

      dear Sirs,

I, as registered keeper, wish to invoke your appeals procedure. The driver was a customer of McDonalds and did not see the signage. In any event the charges are penal and not a genuine pre estimate of loss as well as being an amount larger than permitted under the BPA code of practice to which you subscribe.

I will not name the driver as i am under no statutory obligation to do so.

Please accept my apeal or supply a popla code.

      Yours etc

seems they used a camera at the mcdonalds to do a apnr lookup. the notice has a picture of our car at the entrance and exit.

Here is the McDonalds parking policy

                http://www.mcdonalds.co.uk/ukhome/wh...staurants.html

If you can contact the manager of the site, they may be able to get it cancelled. Otherwise use the appeal system on the back. If they reject and do not cancel, they MUST give you a POPLA code. You can then go to the Ombudsman/POPLA and get it cancelled there.

So appeal to MET telling them the signs were not visible so a reasonable person would be able to see. As such no contract was formed. If they disagree you wish them to supply and unredacted copy of their contract with McD's and details of when the signs were installed and the subsequent maintenance schedule as required by the BPA Code of Practice.

They only accept postal appeals but make sure you get a proof of posting from the post office. Difficult challenges get "lost"
