Hi there, here's hoping you can give me some advice please!
My husband (as the registered keeper) received a parking charge notice from parking eye for going over the paid for time in Leeds aire street car park by 25 minutes. I looked up online how to respond and appeal and copied a template with the relevant details and sent it to them. I expected to receive a popla code but instead I received a letter today citing the Beavis case and saying they need valid evidence indicating that he did not break the terms and conditions stipulated on the signage. The parking charge has been placed on hold for 14 days in order for him to provide additional/evidence. The thing is, what to do now, the reason for not accepting the £100 charge was the pre-estimation of loss. I can send you copies of the letters sent and received.

Hi again, I have now received a POPLA code and a reply from parking eye, rejecting my appeal stating that insufficient time was paid for, and goes on to quote the Beavis case. Having got this far I am now unsure how to fill in the form. Is there a template I should use, and does POPLA already have the correspondence and details exchanged between PE and myself. I have attached copies of the Parking Eye letters and my replies in case you need to see them. I am getting very nervous now so I do hope you can advise me the best way to deal with POPLA. PE seem to be taking a triumphant attitude regarding the Beavis case, the way they are quoting it in their letters. Many thanks.

You have the option of paying £100 or trying to win at popla (admittedly a much harder option now) and paying £100 if you lose. You could ignore but probably end up in court.
As i see it a popla appeal will cost nothing as you'd be asked to pay £100 with or without going to popla so it would be folly to pass up even a small chance to win at popla. I would also ask popla to stay any appeal pending the supreme court ruling on the matter as they did before the court of appeal ruling.

Thank you, it's worth a try. Is there any wording or template that you recommend I use. Or do I copy and paste the letter I originally sent to PE. And I will ask that they stay any appeal pending the supreme court ruling.

Just another thought, if my POPLA appeal fails, would it be worth negotiating with PE for a lesser charge.
