    Ah, see I don't have photos from any further back than a month or so back. Didn't think it would be required as it had all gone quiet.

      I kept them just in case .. I'm sure the photos I have would support your case too but even the photos taken by them show they are playing games. for example they have a close up photo of one of the signs but then in another of their photos it shows clearly that there are 2 cars parked in front of that sign so I couldn't possibly have seen it !

        Hi M1, I have now received the following from Gladstones.

        We act for the Claimant and have notified the Court of our Client’s intention to proceed with the claim.

        Please find enclosed a copy of our Client’s completed Directions Questionnaire, which will be filed with the court upon their request.
        You will note we intend to request a special direction that the case be dealt with on the papers and without the need for an oral hearing

        This request is sought simply because the matter is in our Client’s opinion relatively straightforward and the costs incurred by both parties for attending an oral hearing would be disproportionate. We trust you agree.

        You will note our Client has elected not to mediate. Its decision is not meant to be in any way obstructive and is based purely on experience, as mediation has rarely proven beneficial in these types of cases. Notwithstanding this, our Client would be happy to listen to any genuine payment proposals that you wish to put forward.

        Obviously a papers only case is of no use to me as I have lots of evidence to provide and explain.

          Standard Gladstones try on but there are very few paper hearings. You simply reply that you are a Litigant in person and as such you wish the opportunity for the court to decide on the deficiencies in the claimant's case by means of an oral hearing. You also request that any witnesses the Claimant put forward to be there to answer to their statements.

            We've had the same email today. I trust that the plan is for us to send the same reply i.e. we want an oral hearing and that any witnesses they have should attend.

            Do we email Gladstones? And we we receive a Directions Questionnaire also?

              the directions questionnaire was attached to the email I received .
              My concern here is that you and I are sending the same correspondence, filing the same defence etc all within hours of each other.. they must know we are taking the same advice !

                You simply reply [to the court] that you are a Litigant in person. You do not need to contact Gladstones except to send them your copy of your DQ once you have filled it out.

                Suggested answers

                A1 = NO to mediation (they want the whole amount, you want to pay them nothing, so no scope for mediation. This will not go against you)


                B = fill in all the details, name, address, etc


                C1 = YES to small claims track – this is the limited costs track for claims up to £10,000 in value


                D1 = name of your local County Court – unless you are a Ltd company, the case files will be transferred there


                D2 = NO to expert evidence (this relates to medical negligence cases and suchlike)


                D3 = 1 witness (that’s you) (or more if you are going to get another person to provide a statement)


                D4 = Put down the dates of any pre-booked holidays, NO to interpreter (unless you need one).

                    Dave, I'm not so concerned by that. We could easily be taking advice from a local solicitors. It should matter that we're both getting advice online.

                    The line in the email from Gladstones about listening to any payment proposals makes me wonder if this is a last gasp attempt and whether we are reaching the endgame in this whole thing.

                      I wouldn't know, But either way, I am more than happy to face them in a court, I can show thet even the photo's they took themselves are misleading..

                      It's borderline fraud !

                      A part of me actually wants to see what a judge would say about the evidence and their company when it's exposed in public !

                        They can have as many witnesses, experts and highly paid barristers they want. Look at the claim and tell me what the hell they can do with them ? Feck all, that's what. They need to amend, they've been asked to amend, they'll try at court to be allowed to amend and we'll ask the judge to tell them to get stuffed as they were aware of their faults and chose not to do anything and should not be rewarded for such a terrible attitude by the granting of an amendment which will necessitate an adjournment. (bear in mind i've always said we will be ready on the parking just in case).

                          Ok M1, fair enough.. I guess the court will send me a DQ to complete? or do I need to contact the court to tell them I have received the DQ from GS
                          but wish to have the case heard before the court?

                                On the DQ form, in Box D1, , I just added a comment stating 'I DO NOT ACCEPT THE REQUEST FOR A PAPERS ONLY HEARING'
