  • NPE Appeal - WON!

    Hi, I hope you can give me some advice. I received a parking charge notice from NPE after parking overnight at the MJB Hotel in Dereham. I immediately called the hotel and explained that I had complied with their requirement to text through various details to them. I subsequently emailed the hotel with a screenshot from my phone showing that I had texted them details of my car Reg No and also my room number. Following their email response, I lodged an appeal with NPE which has been rejected.

    I understand that the hotel needs to deter non customers from using their land. But I was a legitimate customer, sent them evidence of this and how I had tried to comply with their requirements to text info.

    It is a peculiar triangular relationship between the customer, the hotel and NPE. In this case, the mistake appears to be by the hotel who sent me an email confirmation of my booking with instructions. According to this, I was to text the Car Reg No, the name of the hotel, the booking Ref No and the number of nights.

    I texted my car Reg No and Hotel room number. I could not find the booking Ref No in the confirmation email. NPE have subsequently told me the Ref No is in the address line of the email. How was I supposed to know that 777749656-brwb.sgex.ncpu.swee@property.booking.com contains the booking Ref?

    It is true that I did not fully comply with their email instructions... but I had no way of accessing this booking Ref, not knowing at the time it was in the address line of the email which I had printed out. I also did not know MJB had more than one hotel and assumed they knew which one I was staying at.

    There is nothing in their email which states that customers must also print off and take with them the confirmation from booking.com which does include the booking Ref No.

    As a legitimate customer of the hotel, you would expect they would have the good grace to cancel the parking charge. As they have not, I am tempted to appeal via POPLA. Do you think I have a chance?

    Yes. If you post the PCN and appeal up i'll do one for you.

    Tripadvisor may get a more helpful response from the hotel.

        I attach the hotel confirmation email. This is where things went wrong. The screaming text, the confusing instructions and the lack of booking Ref No.

            Hi slightly worried about silence from your end.

            The appeal rejection I received from NPE is dated 1st October, so I have until 14th/15th if I am to pay the reduced fine. I would rather appeal to POPLA if you think that I have a good chance of success. I am slightly unclear as to what you might or might not be able to provide.... I will need some time to go through the POPLA. Should I write to NPE and tell them this is what I propose to do?

            I guess I just want reassurance if you can help me win my case or not. I much appreciate the service that you provide.

                    Hi !

                    I need to complete my POPLA appeal tomorrow at the latest. Studying the letter of rejection I was sent by NPE, I have noticed that the image they include of a sign that states parking is restricted etc etc does not appear to be of the hotel where I stayed and parked. The wall in the background is nothing like the hotel wall or the perimeter wall.
                    Is this any help with my appeal?

                        That explains entering a popla appeal quite well.

                        You only get one shot so enter everything at once. You may need to convert to pdf, i'm not sure on that.

                          M1 - Thank you for the document you supplied. I managed to complete the POPLA appeal yesterday, with your help. It was tricky at time to know which choices to select. I only uploaded one evidence - of the hotel email with unclear instructions. At the end it was a bit scary when I pressed submit and instead of a message to say it had submitted OK, I got a message saying if I left the screen all my changes would be lost. However, I finally got an acknowledgement of my submission - and before the deadline too!

                          I presume I will be notified in due course of next steps, but I really wanted to say thank you for your hard work.

                            To be honest i'm not 100% sure if you are notified or not. I assume so. You can always manually check it every few days until you find out.

                              After a long wait of three and a half months, I received notification today that I had won my appeal against NPE and MJB Hotels! I am so grateful since, as a legitimate customer of MJB Hotels, I was entitled to park and their instructions to me were unreasonable. So I would have felt doubly cheated if I had been forced to pay their trumped up charge!

                              With many many thanks to Legal Beagles and especially to M1 who delivered the majority of what I uploaded to POPLA.

                              Best wishes to all the many drivers also facing trumped up charges - go for it!
