    Re: UKPC Cheltenham Parking Charge

I've never lost at popla and early indications regarding the new adjudicators are favourable, so yes i'm pretty confident.

      That's great.

As I'm appealing as the registered keeper, do I put my your own details in the "Motorists Name", "Motorists Address" etc?

Or do I select the option to appeal on behalf of somebody else?

Behalf, i would say is if i was submitting it on your behalf.

I would say motorist covers registered keeper but doesn't necessarily mean driver. I put line 1 in to cover that.

            I don't see a letter of authority (or a contract ?) ?

                  Re: UKPC Cheltenham Parking Charge

A letter of authority is just that. It is a letter that confirms they have authority from the land owner/occupier to do what they do. a contract is just the formal agreement between the land owner/occupier and parking company.

The British Parking Association code of practice stipulates a contract is need. No proof of it means we win.

They mention a letter of authority but don't seem to have included it.

Is it not that witness statement I've just attached?

I think it's meant to be. I'll get back to you later tonight or tomorrow.

                          Re: UKPC Cheltenham Parking Charge

I would like to respond to the operators evidence as follows :-

The letter of authority pre dates both the PCN and the suspension from DVLA access for the operator. As this suspension is clearly a major breach of the BPA code of practice it would be dubious to accept a letter of authority that precedes this. Nor is it proof.

The operator has admitted that they did not comply with PoFA 2012 schedule 4 and has no knowledge of the driver. All appeals were made by the registered keeper.

                            Thank you

How do I respond to their evidence?

                            Are you confident we'll win?

If you log in to popla you should see how to do it.

                              I'd have thought you'll win.

                                Re: UKPC Cheltenham Parking Charge

I received an e-mail from UKPC with their evidence.

However, I have not received anything from POPLA. In addition, when I track my appeal online on the POPLA website, it is still saying the operator's evidence is outstanding?
