    Well you've won. Their claim has been struck out.

    Probably not how you wanted to win, as it would have been nice to see Mr Shwarts in court, but never gonna happen....

    They can apply to overturn the strike, I think within 7 days (usually says on the order)

    Actually double check with the court that that isn't for the 19th May hearing... shouldn't be but best to be certain.

        Thanks. Have a feeling this might be for the 19th May hearing. Had been trying to find out earlier form the court if the hearing fee had been paid. It was due 7th May. Birmingham apparently need up to 10 working days for things to show on their system, but when I rang back I think they said Deal had until 23rd to pay, and I would have to wait another 10 working days to find out. Then I received the Order.

          bummer - still best give them a buzz and check with them. You haven't been ordered to do anything before the 4th August hearing so there's no urgency, just for your own peace of mind.

            I phoned the court contact centre twice and they were not quite sure what was going on. However, I received another letter this week referring to my call confirming that all hearings listed for the claim against me have been vacated because the claim stands struck out.

            So huge thanks to everyone at Legal Beagles and especially M1 for guidance and support.

            Am considering claiming my expenses from Deal, although I as I did most things on-line my only monetary outgoing, I think, was £0.78 for a second class stamp. Must have spent a couple of hours doing things though.
