    Re: Deal - Chickenmadras

I spoke to Salford last week and all OK. They had my N149 on file and are waiting to hear from Deal.

Today I answered a withheld number that turned out to be a young lady from Deal. She asked if I would be interested in settling out of court. This call was not pre-arranged via Salford as part of their mediation service.

That's the 2nd one of those i've read today. Somebody is trying to coin it in before the charade falls down, imo.

A letter/email to see if your local court is interested in stopping claimants take the mick out of them.

Thanks M1. Just picked this up. Yesterday I received a date for the court hearing; it's early in May. Should I send the letter/email regardless? I have the deputy district judge's name. Interesting that the judge has decided this case should go to a hearing, despite my defence including the uncertainty surrounding Deal's solicitor.

I'll sort out the mediation again as encouraged by the court. However, last time I looked into mediation it seemed prerequisite that to negotiate with Deal I have to be prepared to offer them some payment.

            I'd send it.

Mediation isn't really going to work unless you are prepared to give them something. All you really want to do is look like you are trying which makes the court think more of you. They don't know you weren't that interested in negotiation. Once you've tried once and they don't take part you're job, on that score, is done.

Received a reply from the Court.

              "Dear Sir

Re: Case number: xxxx Debt Enforcement & Action Limited v Me

I refer to your email of 9th March 2015

The only way the Court will consider such a request is if the request is made by application and the fee of £155 is paid, regardless of the amount of the claim.

              Yours faithfully.

              Mr
              Small Claims Section"

Pity. If it was say £50 I'd would have been tempted. Never mind. Onwards.

Some courts are more pedantic about the rules than others. Still we should still win.

Received A General Form of Judgment or Order letter today. My hearing in May is vacated. Block listed preliminary hearing now in August and Mr. M Shwarts has to be there in person. Claimant also to provide copies of the assignment of the alleged debt.

                  Hmm, this should be interesting.

Had another letter from the court today indicating that as the claimant has failed to pay the hearing fee the claim has been stuck out and the hearing vacated. Now I'm confused.
