You could have a go at working on a witness statement while waiting for mystery1 to get back to you

You still have pics of bad signage though, right ?

Then it's just a witness statement but that's a bit away yet.

Yes i still have the photos of the signage both day and night pics.

Any pointers on how to prepare a witness statement or can that wait for nearer the time.

As M1 says ... it's a while away yet  but here's a link to an example WS that you can play around with in the meantime - http://www.legalbeagles.info/forums/...ness-Statement

Well it depends.

Bad signage is a defence still. Penalties and unfairness are not. Some judges will be for you on bad signage and others might just discard it.

If you feel lucky and want to fight you certainly have a chance.

If you feel like you can't be bothered or can't win or it's not worth the risk of turning it in to a £200 or so loss in total then see if they'll negotiate as they actually lose money by the time they have paid LPC law to attend on their behalf.

Hi All
My case is due to be heard on the 13th of this month, However Im thinking better to get this sorted asap as i do not think i will be able to win.
I have tried to contact PE but the advisor said it was late at this stage and would need to go through the court so was not able to discuss any ways to settle this out of court.
Is this correct?
Do i have any other options to pay this off?

Re: Parking Eye Claim form received

Court cases can be settled at any point before judgement is handed down, even if the judge has heard the case and is having a coffe before announcing a decision.

Give it one more go (you might speak to someone a bit more clued up). If it fails ask for an email address so you can confirm details of the call which would come in handy when discussing costs in court. If there is no discount on the court claimed amount i'd be asking if it is worth paying the full amount since it is pretty unlikely to cost you any more when one considers that the firm used to cover parkingeyes cases doesn't charge travelling costs. The only way you'd get hit for more is if they applied for extra costs based on unreasonable behaviour and a judge agrees. defending is not in itself unreasonable and given you'd have an email saying they wouldn't discuss negotiating with you they'd be more at risk on that front !

Do i have any other options to pay this off?
As in instalments ?

If so, Parking eye may agree but if they don't they court might. It will be recorded on your credit file unless parking eye agree without court intervention.

If you mean can you pay in full and essentially void the court hearing, yes you can.

Did you submit a witness statement and the photos ?

I have not submitted any Witness statement nor do i have one ready.
The only thing submitted had been the initial defense with photos.

Re: Parking Eye Claim form received

I have managed to get through to PE and this time been told that it can be paid off via their automated system and once that is done they notify the court the following day and thats the end of it.

I am considering this option as im unavailable on the hearing date now( only jus found out) also am not feeling too confident as i dont have much to go on to win.

It's your call. I'd certainly want a discount though. It actually costs them money to send representation and as such they make a loss even if they win.

so the cost would be £145 which includes court and Solicitor costs.
and i asked earlier but was told that's the best they are going to do. However i will try my luck again by calling and hopefully get someone with a heart...lol
worst case scenario ill pay it off and get it over with... Either way this forum has been awesome and truly have appreciated all help that has been provided

If you do want to back out then offer them £50, if that is acceptable to you, and see where it goes.
